{"data":{"id":"us-ky/krs-227a.040","jurisdiction":"us-ky","citation":"KRS 227A.040","heading":"Powers and duties of department.","body":"(1) The department shall administer and enforce KRS  227A.010 to 227A.140 and\nshall evaluate the qualifications of applicants for licensure.\n(2) The  department may  issue subpoenas, examine witnesses, pay appropriate\nwitness fees, administer oaths, and investigate allegations of practices violating\nKRS  227A.010 to 227A.140 or the administrative regulations promulgated\nunder KRS 227A.010 to 227A.140 and KRS Chapter 13A.\n(3) The  department shall conduct hearings under KRS  Chapter 13B and keep\nrecords and minutes necessary to carry out the functions of KRS  227A.010 to\n227A.140.\n(4) The  department shall evaluate the qualifications of applicants and issue\nlicenses to qualified candidates.\n(5) The department shall renew licenses.\n(6) The department may:\n(a) Refuse to issue or renew a license;\n(b) Suspend  or revoke a license;\n(c) Impose supervisory or probationary conditions upon a licensee;\n(d) Impose administrative disciplinary fines;\n(e) Issue written reprimands or admonishments; and\n(f) Take any combination of the actions permitted in this subsection.\n(7) The  department may  seek injunctive relief in the Circuit Court of Franklin\nCounty, in the county in which the violation occurred, or in the county where\nthe business of the accused is located to stop any unlawful practice in KRS\n227A.010 to 227A.140 and administrative regulations promulgated thereunder.\nThe  department may  also seek injunctive relief for unlicensed persons who\ninappropriately use the title \"electrical contractor,\" \"electrician,\" or \"master\nelectrician.\"\n(8) The department, with comments from the Housing, Buildings and Construction\nAdvisory Committee  if required by  KRS  198B.030(8), may  promulgate\nadministrative regulations to create a code of ethics and procedures governing\nthe licensure of electrical contractors, electricians, and master electricians.\n(9) The department may enter into reciprocal agreements with other states having\nlicensure, certification, or  registration qualifications and  requirements\nsubstantially equal to those of this state.","path":["KRS Chapter 227A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46981","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:44Z","sha256":"efab24f44e1a4e122bee5b50d7ce94ec2d991d271ec55b27b171e81a5cbb11fe","source_id":"us-ky","stale":false,"prev":"us-ky/krs-227a.030","next":"us-ky/krs-227a.050"},"notice":"GroundRules: Original legal text.
