{"data":{"id":"us-ky/krs-230.215","jurisdiction":"us-ky","citation":"KRS 230.215","heading":"Legislative purpose for chapter and KRS Chapter 238 -- Racing and","body":"gaming corporation's power to exclude undesirables -- Jurisdiction over sports\nwagering, fantasy contests, fixed-odds wagering, and charitable gaming.\n(1) (a) It is the policy of the Commonwealth of Kentucky, in furtherance of its\nresponsibility to foster and to encourage legitimate occupations and industries\nin the Commonwealth and to promote and to conserve the public health,\nsafety, and welfare, and it is he reby declared the intent of the Commonwealth\nto foster and to encourage the horse breeding industry within the\nCommonwealth and to encourage the improvement of the breeds of horses.\n(b) Further, it is the policy and intent of the Commonwealth to foster and  to\nencourage the business of legitimate horse racing with pari -mutuel wagering\nthereon in the Commonwealth on the highest possible plane. Further, it hereby\nis declared the policy and intent of the Commonwealth that all racing not\nlicensed under this chapter is a public nuisance and may be enjoined as such.\n(c) Further, it is hereby declared the policy and intent of the Commonwealth that\nthe conduct of horse racing, or the participation in any way in horse racing, or\nthe entrance to or presence where horse racing is conducted, is a privilege and\nnot a personal right; and that this privilege may be granted or denied by the\ncorporation or its duly approved representatives acting in its behalf.\n(d) Further, it is hereby declared the policy and intent of the Co mmonwealth that\ncitizens shall be allowed to enjoy wagering on sporting events in a controlled\nenvironment that protects the citizens from cheating and fraud, and that such\nwagering shall be best controlled and overseen by the Kentucky Horse Racing\nand Gam ing Corporation, which has demonstrated a long and successful\nhistory of regulating wagering.\n(e) Further, it is hereby declared the policy and intent of the Commonwealth that\ncharitable gaming conducted by charitable organizations is an important\nmethod of raising funds for legitimate charitable purposes and is in the public\ninterest. The intent of this chapter and KRS Chapter 238 is to prevent the\ncommercialization of charitable gaming, to prevent participation in charitable\ngaming by criminal and other u ndesirable elements, and to prevent the\ndiversion of funds from legitimate charitable purposes, and that charitable\ngaming shall be overseen by the Kentucky Horse Racing and Gaming\nCorporation.\n(f) It is hereby declared the intent of the Commonwealth to ve st in the\ncorporation the power to regulate the industries under its jurisdiction and\nensure compliance, transparency, and protection of the public in accordance\nwith applicable law.\n(2) (a) It is hereby declared the purpose and intent of this chapter in t he interest of\nthe public health, safety, and welfare, to vest in the corporation forceful\ncontrol of horse racing in the Commonwealth with power to promulgate\nadministrative regulations prescribing conditions under which all legitimate\nhorse racing and wa gering thereon is conducted in the Commonwealth so as\nto encourage the improvement of the breeds of horses in the Commonwealth,\nto regulate and maintain horse racing at horse race meetings in the\nCommonwealth of the highest quality and free of any corrupt,  incompetent,\ndishonest, or unprincipled horse racing practices, and to regulate and maintain\nhorse racing at race meetings in the Commonwealth so as to dissipate any\ncloud of association with the undesirable and maintain the appearance as well\nas the fact  of complete honesty and integrity of horse racing in the\nCommonwealth.\n(b) In addition, it is hereby declared the purpose and intent of this chapter to vest\nin the corporation exclusive jurisdiction over sports wagering, fantasy\ncontests, and fixed -odds w agering in the Commonwealth, with power to\npromulgate administrative regulations prescribing conditions under which all\nsports wagering, fantasy contests, and fixed -odds wagering are to be\nconducted.\n(c) In addition to the general powers and duties vested in the corporation by this\nchapter, it is the intent hereby to vest in the corporation the power to eject or\nexclude from association grounds or any part thereof any person, licensed or\nunlicensed, whose conduct or reputation is such that his or her presen ce on\nassociation grounds may, in the opinion of the corporation, reflect on the\nhonesty and integrity of horse racing or interfere with either the orderly\nconduct of horse racing or the orderly conduct of sports wagering.\n(d) In addition, it is hereby declared the purpose and intent of this chapter to vest\nin the corporation exclusive jurisdiction over charitable gaming in the\nCommonwealth, with power to promulgate administrative regulations\nprescribing conditions under which all charitable gaming is to be conducted.\n(e) In addition to the general powers and duties vested in the corporation by this\nchapter, it is the intent hereby to vest in the corporation the power to eject or\nexclude from charitable gaming facilities or any p art thereof any person,\nlicensed or unlicensed, whose conduct or reputation is such that his or her\npresence at a charitable gaming facility may, in the opinion of the corporation,\nreflect on the honesty and integrity of charitable gaming or interfere with  the\norderly conduct of charitable gaming.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58102","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:46Z","sha256":"95790c18120dd996c6fef77ba9d8c2be569c44d5d806983d7493179975c37f1c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.210","next":"us-ky/krs-230.217"},"notice":"GroundRules: Original legal text.
