{"data":{"id":"us-ky/krs-230.262","jurisdiction":"us-ky","citation":"KRS 230.262","heading":"Child support arrearage registry -- Definitions for section -- Duties of","body":"Attorney General -- Duties of licensed online gaming operator -- Penalties --\nAdministrative regulations.\n(1) As used in this section:\n(a) \"Child support arrearage\" mean s a past -due child support obligation of five\nhundred dollars ($500) or more owed by an individual per Title IV -D case\npursuant to a Kentucky court order or an order of another state registered and\nenforceable in Kentucky;\n(b) \"Disqualified person\" means a ny individual who appears on the child support\narrearage registry maintained pursuant to subsection (2) of this section;\n(c) \"Licensed online gaming operator\" means any person or entity holding a\nlicense issued by the Kentucky Horse Racing and Gaming Corpo ration who\noffers online gaming, online sports wagering, or fantasy contests to persons\nlocated within the Commonwealth; and\n(d) \"Online gaming\" includes any gaming that is wagered upon a website, mobile\napplication, or any other off -site technology approved by the Kentucky Horse\nRacing and Gaming Corporation pursuant to this chapter.\n(2) The Office of the Attorney General or applicable administrative body shall:\n(a) Compile and maintain a child support arrearage registry consisting of the\nname, date of bir th, and Social Security number of each individual who owes\na child support arrearage as defined in subsection (1)(a) of this section; and\n(b) 1. Transmit an updated registry to the corporation on a monthly basis, or\nmore frequently as practicable.\n2. Upon receipt of the updated registry, the corporation shall disseminate\nthe registry to each licensed online gaming operator.\n(3) A licensed online gaming operator shall:\n(a) Prior to creating an account for any applicant, verify whether the applicant\nappears on the child support arrearage registry; and\n(b) Deny account creation to any applicant who is a disqualified person.\n(4) A licensed online gaming operator shall, upon receipt of each updated registry\ntransmitted under subsection (2) of this section, cross-reference the updated registry\nagainst its existing account holders. Any account holder identified as a disqualified\nperson shall have his or her account suspended within five (5) business days of\nreceipt of the updated registry. The operator shall pr ovide notice to the account\nholder of the suspension and the reason therefor.\n(5) A suspended account shall be reinstated when the individual no longer appears as a\ndisqualified person on the registry transmitted under subsection (2) of this section.\nReinstatement shall occur no later than five (5) business days following the licensed\nonline gaming operator's receipt of an updated registry on which the individual does\nnot appear.\n(6) A licensed online gaming operator that knowingly creates an account for, o r\nknowingly permits continued participation by, a disqualified person shall be subject\nto administrative penalties imposed by the applicable licensing authority, including\nsuspension or revocation of the operator's license.\n(7) A cause of action shall not lie against a licensed online gaming operator for account\ndenial or suspension undertaken in good-faith compliance with this section.\n(8) The applicable licensing authority shall promulgate administrative regulations\nnecessary to implement this section wit h respect to operators and products under\ntheir respective jurisdiction, including procedures for secure data handling and the\naccount reinstatement process.\n(9) This section shall not be construed to apply to persons licensed to conduct\ncharitable gaming under KRS Chapter 238.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58091","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:46Z","sha256":"46504631bc48397e34bb0d0108b8524e239d697fb78cf4aad061a3548840fd6f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.260","next":"us-ky/krs-230.265"},"notice":"GroundRules: Original legal text.
