{"data":{"id":"us-ky/krs-230.265","jurisdiction":"us-ky","citation":"KRS 230.265","heading":"Kentucky Equine Drug Research Council.","body":"(1) (a) There is hereby created a panel, to be known as the Kentucky Equine Drug\nResearch Council, to advise the corporation on the conduct of equine drug\nresearch and testing commissioned by the Kentucky Horse Racing and\nGaming Corporation.\n(b) The council shall consist of nine (9) members appointed by the Governor. It is\nrecommended that the Governor appoint one (1) person from each of the\nfollowing groups, organizations, or professions:\n1. A veterinarian, selected from a list of three (3) submitted by the\nKentucky Association of Equine Veterinarians;\n2. A horseman, selected from a list of three (3) submitted by the Kentucky\ndivision of the Horsemen's Benevolent and Protective Association;\n3. A pharmacologist, selected from a list of three (3) submitted by the\nUniversity of Kentucky;\n4. A Thoroughbred breeder, selected from a list of three (3) submitted by\nthe Kentucky Thoroughbred Owners and Breeders, Inc.;\n5. A legislator, selected from a list of three (3) submitted by the Legislative\nResearch Commission;\n6. A re presentative of a licensed racing association, chosen by the\nGovernor;\n7. A member of the harness racing industry, selected from a list of three (3)\nsubmitted by the chairman of the Kentucky Horse Racing and Gaming\nCorporation;\n8. A member selected from a list of three (3) submitted by the Kentucky\nHarness Horsemen's Association; and\n9. A member of the Kentucky Horse Racing and Gaming Corporation,\nselected from a list of three (3) submitted by the chairman of the\nKentucky Horse Racing and Gaming Corporation, to serve as chairman.\n(c) The council shall meet at the call of the chairman, a majority of the council, or\nat the request of the corporation. Members shall serve at the pleasure of their\nrespective sponsoring organizations and shall receive no compensation for\nserving.\n(2) The Kentucky Equine Drug Research Council shall:\n(a) Review equine drug research and testing research being conducted at the\nUniversity of Kentucky, or with state funds;\n(b) Review and report to the corporation on drug research and testing research\nbeing conducted elsewhere;\n(c) Advise the corporation and ma ke recommendations for establishing an\neffective drug regulatory policy for Kentucky racing; and\n(d) Report to the General Assembly any needed changes regarding the regulation\nof drugs in horse racing in the Commonwealth of Kentucky.\n(3) (a) The funds received by the corporation pursuant to KRS 138.510 shall be used\nfor financing:\n1. Drug research;\n2. Testing research;\n3. Equine medical research;\n4. Equine health research issues; and\n5. Any regulatory or administrative activity of the corporation that is\nrelated to the research and issues described in subparagraphs 1. to 4. of\nthis paragraph. Any expenditure under this subsection shall relate to the\nracing industry in Kentucky.\n(b) In authorizing expenditures, the council and the corporation shall give funding\npriority to the activities described in this subsection which will take place, or\nare proposed to take place, in Kentucky over similar activities taking place\noutside Kentucky. However, expenditures under this subsection in furtherance\nof activities taking place outside Kentucky may be approved if the council and\nthe corporation determine that those expenditures will contribute to\nimprovement in Kentucky's racing industry and to the development of a useful\nknowledge base relating to the subjects express ed in paragraph (a)1. to 5. of\nthis subsection.\n(c) The money received under this subsection shall be in addition to any funds\nappropriated to the corporation for these purposes in the executive budget.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54690","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:46Z","sha256":"01a94a7f82adf05944e2dfcd6a41eeff635a076dd19127117aebd32c2305dc83","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.262","next":"us-ky/krs-230.270"},"notice":"GroundRules: Original legal text.
