{"data":{"id":"us-ky/krs-230.310","jurisdiction":"us-ky","citation":"KRS 230.310","heading":"License for participants in horse racing, sports wagering, or charitable","body":"gaming.\n(1) (a) Every person not required to be licensed under KRS 230.300 who desires to\nparticipate in horse racing in the Commonwealth as a horse ow ner, trainer,\njockey, apprentice jockey, agent, stable employee, racing official, association\nemployee, or employee of a person or concern contracting with the\nassociation to provide a service or commodity and which requires their\npresence on association g rounds during a race meeting, or veterinarian,\nfarrier, horse dentist, or supplier of food, tack, medication, or horse feed, or in\nany other capacity as the corporation may establish by administrative\nregulation, shall first apply to the corporation for a license to participate in the\nactivity on association grounds during a race meeting. A person required to be\nlicensed by this section shall not participate in any activity required to be\nlicensed on association grounds during a race meeting without a valid  license\ntherefor.\n(b) An applicant for a license shall submit to the corporation fingerprints as may\nbe required and other information necessary and reasonable for processing a\nlicense application. The corporation is authorized to exchange fingerprint dat a\nwith the Department of Kentucky State Police and the Federal Bureau of\nInvestigation in order to conduct a criminal history background check of an\napplicant.\n(c) The corporation may issue a license if it finds that the financial responsibility,\nage, experience, reputation, competence, and general fitness of the applicant\nto perform the activity permitted by a license are consistent with the best\ninterest of racing and the maintenance of the honesty, integrity, and high\nquality thereof.\n(2) (a) Every perso n who desires to participate in sports wagering in the\nCommonwealth working in a licensed facility for sports wagering, directly\nsupervising individuals who have the capability of affecting the outcome of\nsports wagering, or having the capability to affect  the outcome of sports\nwagering through deployment of code to production for any critical\ncomponent of a sports wagering system or the capability to deploy code to\nproduction shall first apply to the corporation for a valid occupational license\nto participate in that activity.\n(b) An applicant for an occupational license shall submit to the corporation\nfingerprints as may be required and other information necessary and\nreasonable for processing a license application. The corporation is authorized\nto exchang e fingerprint data with the Department of Kentucky State Police\nand the Federal Bureau of Investigation in order to conduct a criminal history\nbackground check of an applicant.\n(c) The corporation may issue a license if it finds that the financial responsi bility,\nage, experience, reputation, competence, and general fitness of the applicant\nto perform the activity permitted by a license are consistent with the best\ninterest of sports wagering in the Commonwealth, and the maintenance of the\nhonesty, integrity, and high quality thereof.\n(3) (a) As used in this subsection:\n1. \"Affiliate\" means an entity that is owned or controlled in whole or in\npart by the licensee; and\n2. \"Beneficial interest\" means participation in the proceeds of charitable\ngaming either as a licensee, operator, or charitable recipient of the\nproceeds of the charity or foundation that receives proceeds.\n(b) An association or track that holds a license to conduct racing under this\nchapter, or its affiliate, shall not hold a license to conduct charitable gaming\nunder KRS Chapter 238 or have a beneficial interest in the proceeds of\ncharitable gaming.\n(c) This subsection shall not prevent an association or track that holds a license to\nconduct racing under this chapter, or its affiliate, from:\n1. Leasing space to a charitable organization or nonprofit organization at a\ncommercially reasonable rate; or\n2. Conducting raffles or other special limited charity fundr aising events as\nauthorized by the corporation.\n(d) Every person who desires to be licensed to participate in charitable gaming\nshall first meet the standards of this chapter and the standards established in\nKRS Chapter 238.\n(e) The corporation may issue a license if it finds that the financial responsibility,\nage, experience, reputation, competence, and general fitness of the applicant\nto perform the activity permitted by a license are consistent with the best\ninterest of charitable gaming in the Commonwea lth, and the maintenance of\nhonesty, integrity, and high quality thereof.\n(4) A license may be issued for the calendar year for which an applicant applies or, if\nauthorized by administrative regulation of the corporation, a license may be issued\nthat expir es on the last day of the birth month of the licensee. A license may be\nrenewed by the corporation. The license shall be valid at all horse race meetings in\nthe Commonwealth during the period for which it is issued unless suspended or\nrevoked under the adm inistrative regulations promulgated by the corporation under\nthis chapter. The occupational license to participate in sports wagering may be\nsuspended or revoked pursuant to administrative regulations promulgated by the\ncorporation under this chapter. With  respect to horse owners and trainers, the\ncorporation may promulgate administrative regulations to facilitate and promote\nuniform, reciprocal licensing with other states.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58108","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:46Z","sha256":"ab863f2410775fcc93381a40051afc9b075d024a3a69b5d6d4624d21268d5d7f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.300","next":"us-ky/krs-230.320"},"notice":"GroundRules: Original legal text.
