{"data":{"id":"us-ky/krs-230.3615","jurisdiction":"us-ky","citation":"KRS 230.3615","heading":"Limitation on commission of operator of Thoroughbred race track --","body":"Breaks -- Payment for backside improvement fund.\n(1) The commission, including the tax levied in KRS 138.510, deducted from the gross\namount wagered by the association wh ich operates a race track under the\njurisdiction of the Kentucky Horse Racing and Gaming Corporation and conducts\nthe Thoroughbred racing at which betting is conducted through a pari -mutuel or\nother similar system, in races where the patron is required to select one (1) horse,\nand the breaks, which breaks shall be made and calculated in accordance with KRS\n230.295, except on races previously run in which the breaks shall be made and\ncalculated in accordance with KRS 230.295 or retained in the pari -mutuel po ols,\nshall not be more than seventeen and one-half percent (17.5%).\n(2) The commission, including the tax levied in KRS 138.510, deducted from the gross\namount wagered by the person, corporation, or association which operates a race\ntrack under the jurisdiction of the Kentucky Horse Racing and Gaming Corporation\nand conducts Thoroughbred racing at which betting is conducted through a pari -\nmutuel or other similar system shall not exceed twenty -two percent (22%) of the\ngross handle in races where the patron i s required to select two (2) or more horses,\nand the breaks, which breaks shall be made and calculated in accordance with KRS\n230.295, except on races previously run in which the breaks shall be made and\ncalculated in accordance with KRS 230.295 or retained in the pari-mutuel pools.\n(3) The minimum wager to be accepted by any licensed association shall be ten cents\n($0.10). The minimum pay -off on a one dollar ($1) wager shall be one dollar and\nten cents ($1.10); but, in the event of a minus pool, the minimu m pay-off for a one\ndollar ($1) wager shall be one dollar and five cents ($1.05).\n(4) Each association conducting Thoroughbred racing shall pay to the corporation all\nmoneys allocated to the backside improvement fund in an amount equal to one -half\nof one percent (0.5%) of its on-track pari-mutuel wagers.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58137","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:46Z","sha256":"f642c6d1be20966caf9a1a6291551d6fce47ad573a16fd976d8e3232ad4fef71","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.3612","next":"us-ky/krs-230.362"},"notice":"GroundRules: Original legal text.
