{"data":{"id":"us-ky/krs-230.3771","jurisdiction":"us-ky","citation":"KRS 230.3771","heading":"Limitations on and conditions for interstate simulcasting and wagering at","body":"Thoroughbred tracks, harness tracks, and simulcast facilities.\n(1) A Thoroughbred track licensed to conduct Thoroughbred racing may receive\ninterstate simulcasts of Th oroughbred, quarter horse, paint horse, Appaloosa, and\nArabian horse races, and conduct interstate wagering thereon, subject to the\nfollowing limitations:\n(a) A Thoroughbred receiving track may receive interstate simulcasts of\nThoroughbred races and conduc t interstate wagering thereon at any time of\nday and during any live Thoroughbred horse race meet conducted in the\nCommonwealth of Kentucky so long as the Thoroughbred receiving track\nconducting interstate wagering remits to the Thoroughbred host track\nconducting a live meet, from the first awarded day of its live meet through the\nlast awarded day of the same live meet, the amounts provided in paragraph (j)\nof this subsection;\n(b) A Thoroughbred host track which receives interstate simulcasts and conducts\ninterstate wagering thereon during the period of time from the first awarded\nday of its live meet through the last awarded day of its live meet shall offer\nthe simulcasts to all Thoroughbred receiving tracks, all harness tracks not\nsubject to the provisions  of KRS 230.377(2), and all simulcast facilities\nthrough the intertrack wagering system;\n(c) Except as otherwise prohibited by law, a receiving track shall conduct\nintertrack wagering on all live races of all Thoroughbred host tracks on any\nday on which it receives an interstate simulcast for the purpose of conducting\ninterstate wagering;\n(d) No host track shall require that any receiving track or simulcast facility\nreceive the interstate simulcast;\n(e) If more than one (1) Thoroughbred track conducts live racing at the same time\non the same day, no track or simulcast facility may receive an interstate\nsimulcast of Thoroughbred races unless all Thoroughbred tracks conducting\nlive racing at the same time of day agree upon all interstate simulcasts to be\nreceived and the division of the Thoroughbred host track's commission. If\nmore than one (1) Thoroughbred track conducts live racing at different times\non the same day, the Thoroughbred host track with the highest average daily\nhandle, based on the preceding yea r, shall be the host track for purposes of\nsplitting the commissions earned on interstate wagering at receiving tracks\nwithin the Commonwealth. For purposes of this subsection, average daily\nhandle includes live handle, intertrack wagering handle, and simu lcast facility\nhandle. Also for purposes of this subsection, the time of day during which a\nhost track conducts live racing commences with its first published post time\nand concludes ten (10) minutes after the published post time of its last race of\nthe day, regardless of actual post times;\n(f) Each Thoroughbred track which desires to conduct interstate wagering\npursuant to the provisions of this subsection shall during each year make\napplication to the corporation for no less than one hundred percent (100% ) of\nthe number of racing days awarded to the track in 1994 and one hundred\npercent (100%) of the number of races scheduled to be run by the track in\n1993;\n(g) Notwithstanding paragraph (f) of this subsection, any Thoroughbred track\nmay apply for less than  one hundred percent (100%) of the number of racing\ndays awarded to the track in 1994 or one hundred percent (100%) of the\nnumber of races scheduled to be run by the track in 1993, if written approval\nis obtained from the Kentucky Horsemen's Benevolent and  Protective\nAssociation and the Kentucky Thoroughbred Owners and Breeders\nAssociation, Inc.;\n(h) A separate accounting on all interstate simulcasting shall be submitted to the\ncorporation. The accounting shall be submitted in the same format and at the\nsame time that the report for intertrack wagering is submitted;\n(i) If the only simulcast or simulcasts a track participating as a host track makes\navailable for interstate wagering through this state's intertrack wagering\nsystem on any race day are Thoroughb red horse races designated as graded\nstakes races by the Graded Stakes Committee of the Thoroughbred Owners\nand Breeders Association, Inc., then the commission of the receiving track on\nthese interstate wagers shall be split as prescribed by KRS 230.378(3) ;\notherwise, the commission of the receiving track shall be split as prescribed\nby paragraph (j) of this subsection. Interstate simulcasts received by a\nThoroughbred host track under the conditions set forth in this paragraph shall\nnot be subject to the co nditions set forth in paragraphs (b), (c), (e), and (f) of\nthis subsection;\n(j) A receiving track's commission on interstate wagering, after deduction of\napplicable taxes and any amounts required to be paid by contract to the track\nfrom which the interstate simulcast originated, shall be split as follows:\n1. Twenty-five percent (25%) to the receiving track where the interstate\nwagering occurs;\n2. Twenty-five percent (25%) to the Thoroughbred host track designated\nby paragraphs (a) and (e) of this subsection. However, if the race does\nnot occur between the first awarded day of a live me et and the last\nawarded day of the same live meet, an additional twenty -five percent\n(25%) shall be retained by the receiving track where the interstate\nwagering occurs;\n3. Twenty-five percent (25%) to the purse program of the receiving track\nwhere the interstate wagering occurs; and\n4. Twenty-five percent (25%) to the purse program of the Thoroughbred\nhost track designated by paragraphs (a) and (e) of this subsection.\nHowever, if the race does not occur between the first awarded day of a\nlive meet and the last awarded day of the same live meet, then an\nadditional twenty-five percent (25%) shall be paid to the purse program\nof the receiving track where the interstate wagering occurs; and\n(k) A simulcast facility's commission on interstate wagering on Thoroug hbred\nracing, after deduction of applicable taxes and any amounts required to be\npaid by contract to the track from which the interstate simulcast originated,\nshall be split as provided in KRS 230.380(9).\n(2) A harness track licensed to conduct harness racing may receive interstate simulcasts\nof harness horse, quarter horse, paint horse, Appaloosa, and Arabian horse races\nand conduct interstate wagering thereon subject to the following limitations:\n(a) A harness receiving track may receive interstate simulc asts of harness races,\nquarter horse races, paint horse races, Appaloosa races, and Arabian horse\nraces, and conduct interstate wagering thereon at any time of day and during\nthe course of any live harness horse race meet conducted in the\nCommonwealth of K entucky so long as the harness receiving track\nconducting interstate wagering remits to the harness host track conducting a\nlive meet, from the first awarded day of its live meet through the last awarded\nday of the same live meet, the amounts provided in p aragraph (j) of this\nsubsection;\n(b) A harness host track which receives an interstate simulcast and conducts\ninterstate wagering thereon during its live race meet shall offer the simulcasts\nto all Thoroughbred receiving tracks not subject to the provision s of KRS\n230.377(2), all harness tracks, and all simulcast facilities through the\nintertrack wagering system;\n(c) Except as otherwise prohibited by law, a harness receiving track or a\nsimulcast facility shall conduct intertrack wagering on all live races o f a\nharness host track on any day it receives an interstate simulcast from a harness\nhost track;\n(d) No host track shall require that any receiving track or simulcast facility\nreceive the interstate simulcast;\n(e) If more than one (1) harness track conducts live racing at the same time on the\nsame day, no track or simulcast facility may receive an interstate simulcast on\nharness races unless all harness tracks conducting live racing at that time of\nday agree upon the interstate simulcast to be received and the division of the\nharness host track's commission. If more than one (1) harness track conducts\nlive racing at different times on the same day, the harness host track with the\nhighest average daily handle, based on the preceding year, shall be the host\ntrack for purposes of splitting the commissions earned on interstate wagering\nat receiving tracks within the Commonwealth. For purposes of this subsection,\naverage daily handle includes live handle, intertrack wagering handle, and\nsimulcast facility handle. Also for purposes of this subsection, the time of day\nduring which a host track conducts live racing commences with its first\npublished post time and conclude ten (10) minutes after the published post\ntime of its last race of the day, regardless of actual post times;\n(f) Each harness track which desires to conduct interstate wagering pursuant to\nthe provisions of this subsection shall during each year make application to\nthe corporation for no less than one hundred percent (100%) of the number of\nracing days awarded to the track in 1994 and one hundred percent (100%) of\nthe number of races scheduled to be run by the track in 1993;\n(g) Notwithstanding paragraph (f) of this subsection, any harness track may apply\nfor less than one hundred percent (100%) of the  number of racing days\nawarded to the track in 1994 or one hundred percent (100%) of the number of\nraces scheduled to be run by the track in 1993, if written approval is obtained\nfrom the Kentucky Harness Horsemen's Association, or its successor;\n(h) A separate accounting on all interstate simulcasting shall be submitted to the\ncorporation. This accounting shall be submitted in the same format and at the\nsame time that the report for intertrack wagering is submitted;\n(i) If the only simulcast or simulcasts a track participating as a harness host track\nmakes available for interstate wagering through this state's intertrack\nwagering system on any race day are harness horse races (both final and\nelimination) having a final purse in excess of seventy -five thousa nd dollars\n($75,000), then the commission of the receiving track on these interstate\nwagers shall be split as prescribed by KRS 230.378(3); otherwise, the\ncommission of the receiving track shall be split as prescribed by paragraph (j)\nof this subsection. Interstate simulcasts received by a harness host track under\nthe conditions set forth in this paragraph shall not be subject to the conditions\nset forth in paragraphs (b), (c), (e), and (f) of this subsection;\n(j) A receiving track's commission on interstat e wagering, after deduction of\napplicable taxes and any amounts required to be paid by contract to the track\nfrom which the interstate simulcast originated, shall be split as follows:\n1. Twenty-five percent (25%) to the receiving track where the interstate\nwagering occurs;\n2. Twenty-five percent (25%) to the harness host track designated by\nparagraphs (a) and (e) of this subsection. However, if no live meet is\noccurring, an additional twenty -five percent (25%) shall be retained by\nthe receiving track where the interstate wagering occurs;\n3. Twenty-five percent (25%) to the purse program of the receiving track\nwhere the interstate wagering occurs; and\n4. Twenty-five percent (25%) to the purse program of the harness host\ntrack designated by paragraphs (a) and (e) of this subsection. However,\nif no live meet is occurring, an additional twenty -five percent (25%)\nshall be paid to the purse program of the receiving track where the\ninterstate wagering occurs; and\n(k) A simulcast facility's commission on interstate w agering on harness races,\nafter deduction of applicable taxes and any amount required to be paid by\ncontract to the track from which the interstate simulcast originated, shall be\nsplit as provided in KRS 230.380(9).\n(3) A harness track may only receive int erstate simulcasts of Thoroughbred horse races\nand conduct interstate wagering thereon as provided in subsection (1)(b) of this\nsection. A Thoroughbred track may only receive interstate simulcasts of harness\nhorse races and conduct interstate wagering thereon as provided in subsection (2)(b)\nof this section. A simulcast facility may only receive interstate simulcasts of\nThoroughbred and harness horse races and conduct interstate wagering thereon as\nprovided in subsections (1)(b) and (2)(b) of this section.\n(4) (a) A Thoroughbred track licensed to conduct horse racing may receive interstate\nsimulcasts of quarter horse, paint horse, Appaloosa, and Arabian horse races\nand conduct interstate wagering thereon, subject to the limitations stated in\nparagraph (b) of this subsection.\n(b) A receiving track's commission on interstate wagering, after deduction of\napplicable taxes and any amounts required to be paid by contract to the track\nfrom which the interstate simulcast originated, shall be split as follows:\n1. Twenty-five percent (25%) to the receiving track where the interstate\nwagering occurs;\n2. Twenty-five percent (25%) to the host track; and\n3. Consistent with the horse breed participating in the race:\na. Fifty percent (50%) to the Kentucky paint horse, App aloosa, and\nArabian purse fund established by KRS 230.446 to supplement\npurses for paint horse, Appaloosa, and Arabian horse races in this\nstate; or\nb. Fifty percent (50%) to the Kentucky quarter horse purse fund\nestablished by KRS 230.407 to supplement pu rses for quarter\nhorse races in this state.\n(5) (a) A harness track licensed to conduct horse racing may receive interstate\nsimulcasts of quarter horse, paint horse, Appaloosa, and Arabian horse races\nand conduct interstate wagering thereon, subject to the  limitations stated in\nparagraphs (b), (c), and (d) of this subsection.\n(b) A receiving track's commission on interstate wagering, after deduction of\napplicable taxes and any amounts required to be paid by contract to the track\nfrom which the interstate simulcast originated, shall be split as follows:\n1. Twenty-five percent (25%) to the purse program of the receiving track;\n2. Twenty-five percent (25%) to the purse program of the host track;\n3. Twenty-five percent (25%) to the receiving track; and\n4. Twenty-five percent (25%) to the host track.\n(c) When a paint horse, Appaloosa, or Arabian horse race is run at a Kentucky\nrace track, the commission to the Kentucky paint horse, Appaloosa, and\nArabian purse fund established by KRS 230.446 shall be twenty -two percent\n(22%) from the host track's purse share.\n(d) When a quarter horse race is run at a Kentucky race track, the commission to\nthe Kentucky quarter horse purse fund established by KRS 230.407 shall be\ntwenty-two percent (22%) from the host track's purse share.\n(6) Other provisions of the Kentucky Revised Statutes notwithstanding, any track in a\ngeographic area that contains more than one (1) track within a fifty (50) mile radius\nof any other track may only receive interstate simulcasts on racing of the sam e\nbreed of horse as the track was licensed to race on or before July 15, 1998, except\nany track may receive interstate simulcasts on quarter horse, paint horse,\nAppaloosa, or Arabian horse races.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56024","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:46Z","sha256":"80a8e55b712352eb62767adfd2abbfe80558dd79d14c1075b3e20ff9cf663478","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.377","next":"us-ky/krs-230.3773"},"notice":"GroundRules: Original legal text.
