{"data":{"id":"us-ky/krs-230.405","jurisdiction":"us-ky","citation":"KRS 230.405","heading":"Kentucky quarter horse development fund -- Contributions -- Purposes --","body":"Distribution -- Supplemental purses -- Official registrar -- Administrative\nregulations.\n(1) (a) There is hereby created a corporate account for the Kentucky Horse Racing\nand Gaming Corporation, designated as the Kentucky quarter horse\ndevelopment fund, consisting of moneys allocated to the fund under KRS\n230.3771 together with any other moneys contributed to or allocated to the\nfund from all other sources.\n(b) For the purpo ses of this section, \"development fund\" or \"fund\" means the\nKentucky quarter horse development fund.\n(c) Moneys to the credit of the development fund shall be transferred in the\nfollowing order:\n1. Twenty-five thousand dollars ($25,000) each fiscal year to the Kentucky\nproblem gambling assistance account established in KRS 230.826; and\n2. Remaining moneys to be divided as follows:\na. At least ninety percent (90%) shall be allocated within Kentucky\nas set forth in this section; and\nb. Up to ten percent (10%)  for administration and operation of the\ncorporation.\n(d) Notwithstanding KRS 45.229, moneys to the credit of the fund at the end of\nthe fiscal year shall not lapse but shall be carried forward in the fund to the\nsucceeding fiscal year.\n(e) Interest earnings of the fund shall become a part of the fund and shall n ot\nlapse.\n(2) (a) The Kentucky Horse Racing and Gaming Corporation shall use the\ndevelopment fund to promote races, provide purses for races, and award\nbreeders for horses bred and foaled in the Commonwealth.\n(b) A foal of a pregnant mare bred in another s tate and brought back to Kentucky\nto foal beginning with the breeding year 2025 and ending with foals of the\nfoaling year 2028 may be eligible for moneys from the fund. The pregnant\nmare shall foal in Kentucky and have the resulting foal registered as a\nKentucky-bred quarter horse. Then the same mare, within the same calendar\nyear of the first foal being born, may be bred in Kentucky and registered to\nthe fund. If the mare foals a second time in Kentucky based on this breeding,\nthe resulting foal shall be registered as a Kentucky-bred quarter horse.\n(c) The corporation shall provide for distribution of moneys to the credit of the\ndevelopment fund to persons, corporations, or associations operating licensed\ntracks within Kentucky conducting quarter horse raci ng, on an equitable basis\nas determined by the corporation and in conformance with subsections (3) and\n(4) of this section.\n(3) The Kentucky Horse Racing and Gaming Corporation:\n(a) Shall approve the amount of moneys to be paid from the development fund to\nbe:\n1. Added to the purse provided for each race by the licensed operator of\nthe track; and\n2. Awarded to breeders of Kentucky -bred quarter horses that win races at\nlicensed tracks in Kentucky;\n(b) Shall approve the dates and conditions of races to be hel d by licensed tracks;\nand\n(c) May promulgate administrative regulations in accordance with KRS Chapter\n13A to carry out the provisions of this section.\n(4) (a) Moneys from the fund shall be allocated to each licensed association in an\namount equal to at le ast ninety percent (90%) of the amount the association\ncontributed to the fund.\n(b) Any portion of a supplemental purse that is not awarded and paid over shall\nbe returned to the fund.\n(c) The portion of the supplemental purse provided for any designated r ace shall\nbe awarded and paid to the owner of the horse only if the horse is duly\nregistered with the official registrar under this section.\n(5) (a) In order for an owner of a Kentucky -bred quarter horse to be eligible to\ndemand, claim, and receive a porti on of a supplemental purse provided by the\nKentucky quarter horse development fund, the quarter horse in a designated\nrace for which a supplemental purse has been provided by the Kentucky\nquarter horse development fund shall have been duly registered as a\nKentucky-bred quarter horse with the official registrar of the Kentucky\nquarter horse development fund prior to entry in the race.\n(b) The Kentucky Quarter Horse Racing Association is hereby recognized and\ndesignated as the sole official registrar of the K entucky quarter horse\ndevelopment fund for the purposes of registering Kentucky quarter horse\nstallions, quarter horse mares, and Kentucky -bred quarter horses in\naccordance with the terms of this section and any administrative regulations\npromulgated by th e Kentucky Horse Racing and Gaming Corporation. When\na Kentucky -bred quarter horse is registered with the official registrar, the\nregistrar shall be authorized to stamp the American Quarter Horse Association\ncertificate issued for the quarter horse with th e seal of the registrar, certifying\nthat the quarter horse is a duly qualified and registered Kentucky -bred quarter\nhorse for purposes of this section. The registrar may establish and charge,\nwith the approval of the corporation, reasonable registration fe es for its\nservices in the registration of Kentucky quarter horse stallions, quarter horse\nmares, and Kentucky-bred quarter horses. Registration records of the registrar\nshall be public records and open to public inspection at all normal business\nhours and times.\n(c) Any interested party aggrieved by the failure or refusal of the official registrar\nto register a stallion, mare, or quarter horse as a Kentucky stallion, mare, or\nKentucky-bred quarter horse shall have the right to file with the registrar,\nwithin thirty (30) days of the failure or refusal of the registrar, a petition\nseeking registration of the quarter horse. The registrar shall promptly hear the\nmatter de novo and issue its order.\n(6) The Kentucky Horse Racing and Gaming Corporation shall:\n(a) Supervise registration of, or determine the eligibility of, horses entitled to\nentry in races which receive a portion of purse money from the development\nfund; and\n(b) Determine the conditions, class, and quality of the fund -supported race\nprogram established to carry out the purposes of this section.\n(7) The corporation may promulgate administrative regulations in accordance with\nKRS Chapter 13A to carry out the provisions and purposes of this section and shall\nadminister the Kentucky quarter horse development fund in a manner designed to:\n(a) Promote and aid in the development of the quarter horse industry in\nKentucky;\n(b) Upgrade the quality of quarter horse racing in Kentucky; and\n(c) Improve the quality of quarter horses bred in Kentucky.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56026","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:47Z","sha256":"89f680942fcbbe8047977ddd71b4fae7bf4bed4444de3378d2459810c8020069","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.403","next":"us-ky/krs-230.407"},"notice":"GroundRules: Original legal text.
