{"data":{"id":"us-ky/krs-230.814","jurisdiction":"us-ky","citation":"KRS 230.814","heading":"Requirements for obtaining service provider license -- Application fee --","body":"Factors to be considered by racing and gaming corporation -- Temporary\nlicense -- Revocation of license.\n(1) The corporation may issue a service provider license to a qualified applicant.\n(2) A person applying for a service provider license under this chapter shall pay a\nnonrefundable application fee of fifty thousand dollars ($50,000) to the corporation.\n(3) In determining whether to grant a service provider's license t o an applicant, the\ncorporation shall consider:\n(a) The applicant and its past, current, or future operations; and\n(b) A person that is deemed to have control over the applicant. For the purposes\nof this section, the following persons are deemed to have co ntrol over an\napplicant:\n1. Each corporate holding company, parent company, or subsidiary\ncompany of a corporate applicant or licensee and each person that owns\nfive percent (5%) or more of the corporate applicant or licensee and that\nhas the ability to co ntrol the activities of the corporate applicant or\nlicensee or elect a majority of the board of directors of that corporate\napplicant or licensee;\n2. Each person associated with a noncorporate applicant or licensee that\ndirectly or indirectly holds a benef icial or proprietary interest in the\nnoncorporate applicant's or licensee's business operation or that the\ndirector otherwise determines has the ability to control the noncorporate\napplicant or licensee; and\n3. Any officer or director of an applicant or li censee having the power to\nexercise significant influence over decisions concerning any part of the\napplicant's or licensee's relevant sports wagering business operation in\nthis state.\n(4) A service provider licensee shall pay an annual renewal fee of ten thousand dollars\n($10,000).\n(5) A person applying for a service provider license to conduct sports wagering through\nan agreement with a licensed track may receive a temporary license to imm ediately\ncommence sports wagering operations if the applicant:\n(a) Satisfies the corporation's requirements for a temporary license, which may\nconsider operations in other jurisdictions in the United States; and\n(b) Pays the initial licensing fee of fifty thousand dollars ($50,000) under\nsubsection (2) of this section to the corporation.\n(6) A temporary license granted to an applicant for a service provider to offer sports\nwagering under subsection (5) of this section may be valid for up to one (1) year,\nduring which a permanent license shall be granted or denied. An applicant shall not\nbe eligible for an extended or renewed temporary license. The corporation reserves\nthe right to revoke any license issued pursuant to this chapter if it determines that\nthe licensee has violated any provisions of this chapter or is otherwise deemed unfit\nfor a license.\n(7) Fees paid under this section shall be deposited into the sports wagering\nadministration fund established by KRS 230.817.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54737","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:47Z","sha256":"55a3f7182e0d0080af50398bbd085594047d18bd160eb2eb779e2471f7a47dd7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.811","next":"us-ky/krs-230.817"},"notice":"GroundRules: Original legal text.
