{"data":{"id":"us-ky/krs-230.846","jurisdiction":"us-ky","citation":"KRS 230.846","heading":"Initial license fees -- Annual renewal fees -- License terms -- Procedures.","body":"(1) (a) A fantasy contest service provider that is currently licensed as a sports\nwagering service provider under this chapter shall pay an:\n1. Initial license fee of seven thousand five hundred dollars ($7,500); and\n2. Annual renewal fee of five thousand dollars ($5,000).\n(b) A fantasy contest service provider that is not currently licensed as a sports\nwagering service provider under this chapter shall pay an:\n1. Initial license fee of fifteen thousand dollars ($15,000); and\n2. Annual renewal fee of ten thousand dollars ($10,000).\n(c) 1. As used in this paragraph:\na. \"Adjusted gross fantasy contest receipt s\" means the total sum of\nentry fees collected by a fantasy contest service provider from all\nfantasy contest participants entering a fantasy contest, less\nwinnings paid to fantasy contest participants in the contest,\nmultiplied by the location percentage; and\nb. \"Location percentage\" means the percentage of the total entry fees\nfor each fantasy contest collected from fantasy contest participants\nlocated in the Commonwealth divided by the total entry fees\ncollected from all fantasy contest participants in t he fantasy\ncontest, rounded to the nearest one-tenth of one percent (0.1%).\n2. A fantasy contest service provider that has less than fifty thousand\ndollars ($50,000) a year in adjusted gross fantasy contest receipts shall\npay an:\na. Initial license fee of five thousand dollars ($5,000); and\nb. Annual renewal fee of one thousand dollars ($1,000).\n3. a. If a fantasy contest service provider exceeds the fifty thousand\ndollar ($50,000) threshold any year, the fantasy contest service\nprovider shall within ninety  (90) days of exceeding that threshold\nresubmit an application for licensure to the corporation and pay the\ninitial license fee and annual renewal fee that is applicable to the\nfantasy contest service provider under paragraphs (a) and (b) of\nthis subsection.\nb. The fantasy contest service provider shall only pay the difference\nbetween the applicable initial license fee required in subparagraph\n3.a. of this paragraph and the previously paid initial license fee in\nsubparagraph 2.a. of this paragraph.\n(2) A fantasy contest service provider that was offering contests to persons located in\nthis Commonwealth before July 15, 2026, may continue to offer contests to persons\nlocated in this Commonwealth until the fantasy contest service provider's\napplication has been  approved or denied, if the fantasy contest service provider\nsubmits an application for licensure with the corporation within ninety (90) days\nafter the corporation promulgates administrative regulations to effectuate KRS\n230.830 to 230.848.\n(3) (a) Licenses issued by the corporation shall remain in effect for one (1) year. The\ncorporation shall promulgate administrative regulations in accordance with\nKRS Chapter 13A to establish a process for renewal.\n(b) A fantasy contest service provider may request in w riting to the corporation\nan extension to renew the fantasy contest service provider's license. If the\nfantasy contest service provider allows the license to lapse without requesting\nan extension time to file, the fantasy contest service provider shall resubmit an\ninitial application.\n(4) A fantasy contest service provider applying for a license or renewal of a license\nmay operate during the application period unless the corporation:\n(a) Has reasonable cause to believe that the fantasy contest service provi der is or\nmay be in violation of a provision of KRS 230.830 to 230.848; and\n(b) Requires the fantasy contest service provider to suspend the operation of any\nfantasy contests until the license or renewal of a license is issued.\n(5) The corporation shall en force and collect all fees, penalties, taxes, and any other\npayments imposed under this section.","path":["KRS Chapter 230"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58098","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:47Z","sha256":"5c302a25585d0217a8643ae5dab39b84449b1d13755c1d33888f424c0f35689f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-230.842","next":"us-ky/krs-230.848"},"notice":"GroundRules: Original legal text.
