{"data":{"id":"us-ky/krs-234.120","jurisdiction":"us-ky","citation":"KRS 234.120","heading":"License and minimum liability insurance requirements -- Fees -- More","body":"than one place of business -- Proof of financial responsibility -- License\nsuspension or revocation.\n(1) Subject to the exceptions provided in subsection (2), no person shall engage in any\nof the businesses set out in this subsection without first having provided proof to the\ncommissioner of ability to respond in damages for personal injury and property\ndamages in the amount prescribed, and having obtained from the commissioner the\nrequired license or licenses and paid the prescribed fee therefor:\n(a) Selling or delivering to the ultimate consumer or user of liquefied petroleum\ngas; selling liquefied petroleum gas regulating equipment; repairing,\ninstalling, or connecting of containers , liquefied petroleum gas appliances, or\nliquefied petroleum gas utilization equipment; or filling of D.O.T. liquefied\npetroleum gas containers for ultimate consumer or wholesale dealer. In -state\nliquefied petroleum gas dealers, except those holding a vali d license on July\n15, 1994, shall maintain a liquefied petroleum gas storage facility with an\neighteen thousand (18,000) gallon minimum capacity within the boundaries of\nKentucky. Out-of-state liquefied petroleum gas dealers, except those holding a\nvalid license on July 15, 1994, shall maintain an eighteen thousand (18,000)\ngallon minimum capacity liquefied petroleum gas storage facility within fifty\n(50) miles of the Kentucky border. Until January 1, 2002, the fee for this\nlicense shall be one hundred dollars ($100). Beginning on January 1, 2002, the\nfee for this license shall be two hundred dollars ($200), and the license shall\nbe issued for a period of two (2) years. The minimum liability insurance for\nthis license shall be one million dollars ($1,000,000).\n(b) Selling or delivering liquefied petroleum gas in prefilled or filled -on-site\ncontainers of one hundred (100) pound liquefied petroleum gas capacity or\nless; selling of liquefied petroleum gas regulating equipment; assembly,\nrepairing, installing, or  connecting of liquefied petroleum gas containers,\nliquefied petroleum gas appliances, or any liquefied petroleum gas utilization\nequipment. Until January 1, 2002, the fee for this license shall be fifty dollars\n($50). Beginning on January 1, 2002, the fee  for this license shall be one\nhundred dollars ($100), and the license shall be issued for a period of two (2)\nyears. The minimum liability insurance for this license shall be five hundred\nthousand dollars ($500,000).\n(c) Selling or filling of D.O.T. lique fied petroleum gas containers of forty -five\n(45) pounds or less capacity, or selling liquefied petroleum gas at a specific\nsite for use as a motor vehicle fuel. Until January 1, 2002, the fee for this\nlicense shall be fifty dollars ($50). Beginning on Janu ary 1, 2002, the fee for\nthis license shall be one hundred dollars ($100), and the license shall be issued\nfor a period of two (2) years. The minimum liability insurance for this license\nshall be five hundred thousand dollars ($500,000).\n(d) Storing, for r esale, liquefied petroleum gas in D.O.T. containers of forty -five\n(45) pounds or less capacity, or selling D.O.T. containers, storage cabinets,\nracks, docks, for storage of forty -five (45) pound capacity or less. Until\nJanuary 1, 2001, the fee for this lic ense shall be twenty -five dollars ($25).\nBeginning on January 1, 2001, the fee for this license shall be fifty dollars\n($50), and the license shall be issued for a period of two (2) years. The\nminimum liability insurance for this license shall be one hundr ed thousand\ndollars ($100,000).\n(e) Assembling, repairing, installing, or connecting of liquefied petroleum gas\ncontainers, or regulating equipment, or liquefied petroleum gas appliances, or\nany liquefied petroleum gas utilization equipment. Until January 1, 2001, the\nfee for this license shall be twenty -five dollars ($25). Beginning on January 1,\n2001, the fee for this license shall be fifty dollars ($50), and the license shall\nbe issued for a period of two (2) years. The minimum liability insurance for\nthis license shall be five hundred thousand dollars ($500,000).\n(2) Any person engaged in any business for which a license is required under the\nprovisions of subsection (1) and who engages in the business at more than one (1)\noffice or place of business in this state shall obtain a separate license for each such\noffice or place of business and shall pay therefor the required license fee; except\nthat for the purposes of issuance of licenses under subsection (1) all facilities for the\nstorage only of liquefied  petroleum gas for resale within a radius of twenty (20)\nmiles of an office or place of business shall be considered a part of the office or\nplace of business and shall not require separate licensure.\n(3) The commissioner shall further have the authority t o promulgate and enforce\nreasonable administrative regulations requiring proof of ability to respond in\ndamages for personal injury and property damages in the minimum amounts\nrequired under the provisions of subsection (1), prior to the issuance of a lice nse.\nThe commissioner shall also have authority to suspend or revoke any license issued\nunder this section for willful or gross negligence or for violation of any applicable\nadministrative regulations promulgated under KRS 227.300, but any licensee whose\nlicense is suspended or revoked shall be afforded the opportunity for an\nadministrative hearing conducted in accordance with KRS Chapter 13B.","path":["KRS Chapter 234"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10989","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:48Z","sha256":"16358833e30f20cc032945f59fbf3f64278877ba4bfb31a7a3e9526a6e14d4d7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-234.110","next":"us-ky/krs-234.130"},"notice":"GroundRules: Original legal text.
