{"data":{"id":"us-ky/krs-234.175","jurisdiction":"us-ky","citation":"KRS 234.175","heading":"Certification of equipment installation -- Compliance with administrative","body":"regulations and manufacturer's instructions -- Immunity from liability --\nException.\n(1) Domestic and commercial gas -consuming equipment and appliances shall not be\ninstalled un less their correctness as to design, construction, and performance is\ncertified by:\n(a) A nationally recognized testing agency adequately equipped and competent to\nperform such services evidenced by the attachment of its seal or label to such\ngas appliance s. This agency shall be one which maintains a program of\nnational inspection of production models of gas appliances, at least once each\nyear on the manufacturer's premises;\n(b) By the American Gas Association Laboratories, as evidenced by the\nattachment of  its listing symbol or approval seal to gas appliances and a\ncertificate or letter certifying approval under the above -mentioned\nrequirements, or listing by Underwriters' Laboratories, Inc., shall be\nconsidered as constituting compliance with the provision s of this section,\nproviding, that the manufacturer has approval and certification of same from\nthe Department of Housing, Buildings and Construction.\n(2) Equipment not subject to A.G.A. or laboratory inspection must have approval of the\nDepartment of Housing, Buildings and Construction.\n(3) A person shall not install gas -consuming appliances, equipment, or other\ncomponents of a gas delivery system unless the installation is made in accordance\nwith the instructions of the manufacturer of the appliance, equipment, or component\nand in compliance with the applicable administrative regulations promulgated by\nthe Department of Housing, Buildings and Construction.\n(4) A person shall not alter, modify, maintain, or repair gas -consuming appliances,\nequipment, or oth er components of a gas delivery system unless the alteration,\nmodification, maintenance, or repair is made in accordance with the instructions of\nthe manufacturer of the appliance, equipment, or component and in compliance\nwith the applicable administrativ e regulations promulgated by the Department of\nHousing, Buildings and Construction.\n(5) A person licensed under this chapter or an agent or employee of the person shall not\nbe liable for civil damages for injury to persons or property that result from the\ninstallation, alteration, modification, maintenance, or repair of a gas -consuming\nappliance, equipment, or component by a person other than the licensee or the\nlicensee's agent or employee.\n(6) (a) Except as provided in paragraph (b) of this subsection, a person licensed\nunder this chapter or the licensee's agent or employee who provides gas to an\nend user shall not be liable for civil damages for injury to persons or property\nthat result from the installation, alteration, modification, maintenance, or\nrepair of the gas -consuming appliance, equipment, or component if the\ninstallation, alteration, modification, maintenance, or repair is done without\nthe actual knowledge and consent of the licensee or the licensee's agent or\nemployee.\n(b) A person licensed under this chapter or his or her agent or employee shall not\nbe exempt from liability for civil damages under paragraph (a) of this\nsubsection if the person or his or her agent or employee is negligent or acts\nintentionally, and the negligence or intentional act causes or partially causes\ninjury or damage.","path":["KRS Chapter 234"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=10997","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:48Z","sha256":"edc86178f6d35d6ba96e5c963880f0f04e2ac7f4d09889851caa1b866aa41631","source_id":"us-ky","stale":false,"prev":"us-ky/krs-234.171","next":"us-ky/krs-234.180"},"notice":"GroundRules: Original legal text.
