{"data":{"id":"us-ky/krs-234.272","jurisdiction":"us-ky","citation":"KRS 234.272","heading":"Definitions for KRS 234.270 to 234.302.","body":"As used in KRS 234.270 to 234.302, unless the context otherwise requires:\n(1) \"Commissioner\" means the commissioner of the Department of Housing, Buildings\nand Construction;\n(2) \"Council\" means the Kentucky Propane Education and Research Council created in\naccordance with KRS 234.290;\n(3) \"Department\" means the state Department of Housing, Buildings and Construction;\n(4) \"Education\" means any action to provide information regarding propane, propane\nequipment, mechanical and technical practices relating to t he use of propane, and\npropane uses to consumers and members of the propane industry;\n(5) \"Industry\" means those persons involved in the production, transportation, and sale\nof propane and in the manufacture and distribution of propane utilization\nequipment;\n(6) \"Industry trade association\" means an organization representing the propane\nindustry which is exempt from tax, under Section 501(c)(3) or (c)(6) of the Internal\nRevenue Code;\n(7) \"Odorized propane\" means propane to which an odorant has been added;\n(8) \"Person\" means any individual, corporation, partnership, association, cooperative,\nor other business entity;\n(9) \"Producer\" means the owner of propane at the time it is recovered at a gas\nprocessing plant or refinery, without regard to the state in whic h actual production\noccurs;\n(10) \"Propane\" means a hydrocarbon whose chemical composition is predominately\nC3H8, whether recovered from natural gas or crude oil, and includes liquefied\npetroleum gases and mixtures thereof;\n(11) \"Public member\" means a memb er of the council representing significant users of\npropane, public safety officials, state regulatory officials, or other groups\nknowledgeable about propane;\n(12) \"Research\" means any type of study, investigation, or other activity designed to\nadvance the  image, desirability, usage, marketability, efficiency, or safety of\npropane and to further the development of this information;\n(13) \"Retail marketer\" means a person engaged primarily in the sale of odorized propane\nto the final user of the product or to retail propane dispensers;\n(14) \"Retail propane dispenser\" means a person who sells odorized propane to the final\nuser of the product but is not engaged primarily in the business of these sales; and\n(15) \"Supplier\" means a person, other than a producer, who is the owner of propane in\nthe Commonwealth at the time of odorization or who is the owner of odorized\npropane at the time it is imported into the Commonwealth.","path":["KRS Chapter 234"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11009","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:48Z","sha256":"30ec73f32f08a7a6a058f03171d5ec5c9f6fec3548edbe0af4c8035cec3cb35e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-234.270","next":"us-ky/krs-234.274"},"notice":"GroundRules: Original legal text.
