{"data":{"id":"us-ky/krs-234.298","jurisdiction":"us-ky","citation":"KRS 234.298","heading":"Petition for termination of council and assessment program by referendum","body":"vote -- Timing of referendum -- Termination proceedings.\n(1) Upon petition to the commissioner by producers, suppliers, and retail marketers\nrepresenting thirty-five percent (35% ) of the volume of propane in each class, the\ncouncil shall conduct a referendum to determine if the industry favors termination\nof the council and the assessment. Termination shall not take effect unless it is\napproved by persons representing a majority o f the total volume of odorized\npropane voted in the retail marketer class and by persons representing a majority of\nthe total volume of propane voted in the producer and supplier class.\n(2) The council shall conduct a referendum five (5) years after the da te of the first\nreferendum and each subsequent five (5) year period to determine if the assessment\nshould be continued or terminated.\n(3) If the council expresses in writing its desire to the commissioner to discontinue the\nassessment program and terminate  the program, the commissioner, after reviewing\nthe request and conducting whatever proceedings are deemed appropriate and\nnecessary in connection with the request, may terminate the program effective at the\nend of the calendar year in which the action is taken.","path":["KRS Chapter 234"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11022","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:49Z","sha256":"a6cda4c727ac45f3385f4a3372f042f76e5e623493fd684a3b46e457c4ad3c42","source_id":"us-ky","stale":false,"prev":"us-ky/krs-234.296","next":"us-ky/krs-234.300"},"notice":"GroundRules: Original legal text.
