{"data":{"id":"us-ky/krs-234.330","jurisdiction":"us-ky","citation":"KRS 234.330","heading":"Dealer's license requirement.","body":"(1) A license shall be required of each liquefied petroleum gas motor fuel dealer.\n(2) Application for a license shall be made to the department upon forms prepared and\nfurnished by the department. The application shall contain such information as the\ndepartment deems necessary.\n(3) Concurrently with the filing of an application for a license, a liquefied petroleum\ngas motor fuel dealer shall file with the department a bond as required under KRS\n234.340. No license shall be issued to any person unless such person has furnished a\nbond as provided in KRS 234.340 to secure payment of taxes, penalties and interest\nimposed by KRS 234.310 to 234.440.\n(4) The application in proper form having been accepted for filing, the bond, if\nrequired, having been accepted and app roved and the other conditions and\nrequirements of this section having been complied with, the department shall issue a\nlicense. However, if an application for a license is filed by any person whose license\nhas at any time previously been revoked for cause  by the department, or if the\ndepartment is of the opinion that the person who makes the application as a\nsubterfuge for the real party in interest whose license, prior to the time of filing the\napplication, has been revoked for cause, or that the applicat ion is not for any other\nreason filed in good faith or is not for sufficient cause, the department may, after a\nhearing of which the applicant shall be given ten (10) days' notice in writing and in\nwhich he shall have the right to appear in person or by co unsel and present\ntestimony, refuse to issue a license to that person.\n(5) All licenses shall be valid and remain in full force and effect until suspended or\nrevoked for cause or otherwise canceled.\n(6) A license shall not be assignable or transferable and  shall be valid only for the\nperson in whose name it is issued.\n(7) The department shall keep and file all applications and bonds, with an alphabetical\nindex thereof.","path":["KRS Chapter 234"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11028","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:49Z","sha256":"c5d86c40c920a1bec6f701a849174cd4d2fa5bb0a3c3e588082a7f9cd4f1f4e1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-234.321","next":"us-ky/krs-234.340"},"notice":"GroundRules: Original legal text.
