{"data":{"id":"us-ky/krs-235.070","jurisdiction":"us-ky","citation":"KRS 235.070","heading":"Contents of application -- Documentation to be submitted -- Certificate of","body":"registration or renewal denied, when.\n(1) Every person seeking a title and registration or renewal registration for operation of\na motorboat shall apply to the county clerk of the county as provided in KRS\n235.050 and make application on a form furnished by the Transportation Cabinet.\nThe application shall contain the full name and signature, Social Security number or\nfederal tax identification number, citizenship of applicant, date of birth, sex, present\nresident address, situs for ad valorem tax assessment, the make of the boat, hull\nidentification number (HIN), if any, length, beam, model, and horsepower of motor,\nmaximum capacity, type of hull material, intended use of the bo at, and whether the\nfuel is gasoline, diesel, or other. The application shall state whether the motorboat is\nequipped with marine toilet facilities and shall state if the marine sanitation device\nfor the toilet is properly operating and properly used for t he water body where the\nmotorboat is kept or operated. It shall also state whether the applicant has been\npreviously licensed or registered as an owner, and if so, when and by what state or\ncounty, whether any license registration or certificate number has  been canceled,\nsuspended, revoked, or refused, and if so, the date of and reason for cancellation,\nsuspension, revocation, or refusal, and such other information as may be required.\n(2) Every applicant shall submit the motorboat title or registration with  the application\nas required below:\n(a) If the motorboat is titled in Kentucky, the applicant shall submit the title with\nthe application for title and registration;\n(b) If the motorboat is registered in Kentucky but has not been titled in Kentucky,\nthe applicant shall submit the certificate of registration with the application for\ntitle and registration;\n(c) If the applicant is applying for a registration renewal, he shall submit the\ncertificate of registration;\n(d) If the motorboat is titled in another ju risdiction, the applicant shall submit the\ntitle with the application for title and registration;\n(e) If the motorboat is registered in another jurisdiction, but not titled in any\njurisdiction, the applicant shall submit the certificate of registration wit h the\napplication for title and registration; and\n(f) Vessels holding a United States certificate of documentation shall be exempt\nfrom the provisions of this section.\n(3) Every applicant shall certify that the statements made in the application are true.\nThe clerk shall inform the applicant that making false statements on the application\nregarding a marine boat toilet may lead to being fined under KRS 235.990.\n(4) The clerk shall, after determining that the applicant has complied with the law\nconcerning applications, issue a current certificate of registration or renewal thereof.\n(5) No certificate of registration or renewal thereof for the operation of a motorboat\nshall be issued, if the motorboat is equipped with toilet facilities but is not equipped\nwith a storage container or treatment or disposal system of a type approved under\nregulations promulgated pursuant to this chapter.","path":["KRS Chapter 235"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11050","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:49Z","sha256":"b0e1c2f3c3c0dbb0c6c60f54a8a3f3a252160aa0437fef4c46c65fa79ca8a379","source_id":"us-ky","stale":false,"prev":"us-ky/krs-235.066","next":"us-ky/krs-235.080"},"notice":"GroundRules: Original legal text.
