{"data":{"id":"us-ky/krs-235.240","jurisdiction":"us-ky","citation":"KRS 235.240","heading":"Prohibition of operation of boat negligently or while intoxicated or","body":"drugged -- Consent to test for alcohol or drugs -- Elements of operation under\ninfluence of alcohol or other substance.\n(1) A person shall not operate any motorboat or vessel,  or manipulate any water skis,\nsurfboard, or similar device, in a reckless or negligent manner so as to endanger the\nlife or property of any person.\n(2) A person shall not operate any motorboat or vessel, or manipulate any water skis,\nsurfboard, or similar  device, while intoxicated or under the influence of any other\nsubstance which impairs one's driving ability.\n(3) Any person who operates a vessel upon the waters of the Commonwealth shall be\ndeemed to have given consent to a test or tests as accepted by t he state's evidentiary\nmandate for the purpose of determining the operator's alcohol concentration or the\npresence of other drugs. The test or tests shall be administered at the direction of a\nlaw enforcement officer who has probable cause to believe that the operator may\nhave been violating this section.\n(4) For the purposes of enforcing subsection (2) of this section, the elements of the\noffense are those established in KRS 189A.010(1) to (4), except that the penalties\nfor this offense are set forth in KRS 235.990.","path":["KRS Chapter 235"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49298","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:49Z","sha256":"42be7b800cfe53d67ca3f550a90ffbf99bc3822ea59b2fe01fdc0b1253f275f5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-235.230","next":"us-ky/krs-235.250"},"notice":"GroundRules: Original legal text.
