{"data":{"id":"us-ky/krs-235.310","jurisdiction":"us-ky","citation":"KRS 235.310","heading":"Enforcement -- Powers and status of division employees -- Use of radio","body":"communication equipment.\n(1) The commissioner of the Department of Fish and Wildlife Resources shall\ndesignate officers and employees of the department to enforce the provisions of  this\nchapter, and these officers when duly authorized by the commissioner shall have the\ngeneral powers of a peace officer for the enforcement of other offenses against the\nCommonwealth. In enforcing the provisions of this chapter, these officers and all\nother peace officers of the Commonwealth and its subdivisions shall have the right\nto enter upon all waters of this state, either private or public, for the purpose of\ninspecting certificate of registration and boat numbering, but shall only have the\nright to stop or enter upon boats on such waters if the officer has a reasonable and\narticulable suspicion based upon specific and articulable facts which, taken together\nwith rational inferences from those facts, demonstrate that a violation of the\nKentucky Revised Statutes or an administrative regulation promulgated under this\nchapter has occurred, with any subsequent search of the boat or persons on it being\nauthorized only if supported by probable cause. The provisions of this section shall\nnot apply to license inspections under KRS 150.090(5), but only as to those licenses\nand items specified in that section. They may arrest on sight, without warrant, any\nperson detected by them in the act of violating any of the provisions of this chapter.\nThey shall have t he same rights as sheriffs to require aid in arresting, with or\nwithout process, any person found by them violating any of the provisions of this\nchapter or other offenses against the Commonwealth.\n(2) The officers designated in subsection (1) of this sect ion shall be authorized to\npossess and use radio communication equipment capable of receiving and\ntransmitting on state police radio frequency. The Department of Kentucky State\nPolice shall cooperate with the department for the purpose of radio communicati on\nof these officers when any assistance is necessary.\n(3) The department may conduct periodic inspections of marine sanitation devices\naccording to a regular inspection schedule to be determined by the department. To\nconduct the marine sanitation device i nspection, the department officers and\nemployees may require a motorboat owner to flush a dye through the marine toilet\nin the presence of the department officers or employees or use other appropriate\nmeasures to inspect the device.","path":["KRS Chapter 235"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43434","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:49Z","sha256":"282f9d588f1859e748ad028f15e47f65eb9559de9f268310ebaaab0f68da17db","source_id":"us-ky","stale":false,"prev":"us-ky/krs-235.300","next":"us-ky/krs-235.312"},"notice":"GroundRules: Original legal text.
