{"data":{"id":"us-ky/krs-236.095","jurisdiction":"us-ky","citation":"KRS 236.095","heading":"Owner-user inspectors -- Issuance of commission  -- Requirements --","body":"Reports -- State salary prohibited.\n(1) In addition to boiler inspectors authorized by KRS  236.070, the department\nshall  issue  an  owner-user  inspector commission  to  any  inspector\ncommissioned  by  a  company  operating a  pressure vessel within the\nCommonwealth  if:\n(a) The company has an established and regular inspection program;\n(b) The  company  is listed as  an  accredited Owner-User  Inspection\nOrganization in compliance with the National Board  of Boiler and\nPressure  Vessel Inspectors Accreditation of Owner-User  Inspection\nOrganizations;\n(c) The inspection program, personnel, equipment, and supervision meet the\nrequirements established by the department; and\n(d) 1. The  owner-user inspector applicant has successfully passed the\nexamination required by KRS 236.090; or\n2. The  owner-user inspector applicant holds a commission as an\ninspector of boilers and pressure vessels issued by the National\nBoard of Boiler and Pressure Vessel Inspectors.\n(2) A commission as an owner-user inspector shall be issued only if, in addition to\nmeeting  the requirements of this section, the inspector is continuously\nemployed  by the company  for the purpose of making inspections of pressure\nvessels used or to be used by the company, not of pressure vessels to be\nresold.\n(3) A  licensed owner-user inspector may  not inspect boilers within the\nCommonwealth.\n(4) A licensed owner-user inspector may inspect only pressure vessels insured by\nthe inspector's employing company. When  the vessels are inspected and\nreported as required, the owners and users of insured pressure vessels shall\nbe exempt from payment to the state of inspection fees as provided in KRS\n236.130.\n(5) Each  company  employing a licensed owner-user inspector shall, within thirty\n(30) days following each certificate of inspection, file a report of inspection with\nthe department. Reports shall be submitted upon forms prescribed by the\ndepartment.\n(6) No  reporting of inspections other than the certificate of inspection reports shall\nbe  required unless an inspection reveals that the pressure vessel is in a\ndangerous condition.\n(7) A  licensed owner-user inspector shall receive no salary from, nor shall any\nexpenses be paid by, the Commonwealth.\n(8) Continuance of an owner-user inspector's commission shall be conditioned\nupon the inspector continuing employment for an owner-user company meeting\nrequirements of subsection (1) of this section.","path":["KRS Chapter 236"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46986","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:50Z","sha256":"c094a33bccd3535f3ef729edeebb8c467ce33faf7f91c48af0598d1725af5e75","source_id":"us-ky","stale":false,"prev":"us-ky/krs-236.090","next":"us-ky/krs-236.097"},"notice":"GroundRules: Original legal text.
