{"data":{"id":"us-ky/krs-236.990","jurisdiction":"us-ky","citation":"KRS 236.990","heading":"Penalties.","body":"(1) It shall be unlawful for any person, firm, partnership, or corporation to operate\nin this state a boiler or pressure vessel without a valid certificate of inspection.\nThe operation of a boiler or pressure vessel without a valid certificate, or at a\npressure exceeding that specified in an inspection certificate, shall constitute a\nClass B misdemeanor on the part of the owner, user, or operator. Each day of\nunlawful operation shall constitute a separate offense.\n(2) Any  person who  violates any provision of KRS  236.040(1); 236.080(4);\n236.110(1), (4) and  (5); 236.210(1); 236.220(1); 236.240(1) and  (2);\n236.250(1); or any  proper order or administrative regulation made  or\npromulgated thereunder; or who hinders or obstructs an authorized inspector in\nthe performance of his or her duties under this chapter, shall be subject to the\npenalties in subsection (1) of this section.\n(3) Any  person who  willfully violates any provision of this chapter, or any\nadministrative regulation, emergency  order, order of the state fire marshal,\norder of an authorized deputy state fire marshal, order of the chief boiler\ninspector, or order of any authorized boiler inspector, promulgated or made\npursuant to this chapter, shall be subject to suspension or revocation of any\nappointment, commission, certification, registration, license, or permit made or\nissued by the department and held by that person, in accordance with the\nprocedures specified in KRS  236.220, or in lieu of a suspension or revocation,\nshall be subject to an administrative fine of not less than ten dollars ($10) and\nnot exceeding five hundred dollars ($500) after notice and hearing by the\ndepartment in accordance with KRS  236.220. Each day these violations exist\nshall, in the discretion of the department, be considered as a separate\nviolation.\n(4) As an aid to enforcement of this chapter, or of any administrative regulation or\norder relating thereto, the department or chief boiler inspector may take any\nadministrative action or bring any authorized legal action designed to prevent\nor correct any condition constituting or threatening to constitute a violation of\nany provision of this chapter.","path":["KRS Chapter 236"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46994","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:50Z","sha256":"c5f3e5700b0b2245234397a596abe6e5f041f732cc97332c49185695c08161aa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-236.260","next":"us-ky/krs-237.020"},"notice":"GroundRules: Original legal text.
