{"data":{"id":"us-ky/krs-237.095","jurisdiction":"us-ky","citation":"KRS 237.095","heading":"Persons barred by federal law from purchase of firearms -- Duty to notify","body":"courts and law enforcement agencies of purchase or attempt to purchase --\nProtocol for providing notice -- Duty to notify petitioner -- Immunity from\nliability.\n(1) Upon receivi ng notice that a person barred from purchasing a firearm under 18\nU.S.C. sec. 922(g)(8) has purchased or attempted to purchase a firearm, any agency\nwith the responsibility of entering domestic violence records into the Law\nInformation Network of Kentucky shall notify:\n(a) The court in the jurisdiction where the domestic violence order was issued\nunder KRS 403.750; and\n(b) The law enforcement agencies, as designated by the Department of Kentucky\nState Police, that have jurisdiction in the county where the d omestic violence\norder was issued and in the county of the victim's residence if different from\nthe county where the domestic violence order was issued.\n(2) The Department of Kentucky State Police shall develop a protocol for providing\nnotice to the requir ed court and law enforcement agencies under subsection (1) of\nthis section. Within the protocol, the Department of Kentucky State Police shall\ndesignate which local law enforcement agencies are to receive notice in each\ncounty. A minimum of one (1) law enf orcement agency shall be designated in each\ncounty.\n(3) When a designated law enforcement agency for the county where the domestic\nviolence order was issued or where the victim resides receives notice under\nsubsection (1)(b) of this section, that agency shall make reasonable efforts to ensure\nthat the petitioner who obtained the domestic violence order is notified that the\nrespondent has purchased or attempted to purchase a firearm.\n(4) Any person carrying out responsibilities under this section shall be im mune from\ncivil liability for good faith conduct in carrying out those responsibilities.\n(5) This section shall apply only to domestic violence orders issued, or reissued, on or\nafter July 14, 2000, through July 15, 2002.","path":["KRS Chapter 237"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11127","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:50Z","sha256":"162ae83bc555ae13858795e8a9a94efc09af06a5676e284e5bfd9c87c68fa7f9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-237.090","next":"us-ky/krs-237.100"},"notice":"GroundRules: Original legal text.
