{"data":{"id":"us-ky/krs-237.105","jurisdiction":"us-ky","citation":"KRS 237.105","heading":"Prohibition of cooperation in enforcement of federal ban on firearms,","body":"ammunition, or accessories -- Use of public funds and resources -- Penalties --\nInterpretation.\n(1) As used in this section:\n(a) \"Ammunition\" has the same meaning as KRS 237.060;\n(b) \"Federal ban\" means a federal law, executive order, rule, or regulation that is\nenacted, adopted, or becomes effective on or after January 1, 2021, or a new\nand more restrictive interpretation of a law that existed on January 21, 2021,\nthat infringe s upon, calls into question, prohibits, restricts, or requires\nindividual licensure for or registration of the purchase, ownership, possession,\ntransfer, or use of any firearm, ammunition, or firearm accessory;\n(c) \"Firearm\" has the same meaning as KRS 237.060;\n(d) \"Firearm accessory\" means an item that is used in conjunction with or\nmounted on a firearm but is not essential to the basic function of the firearm,\nincluding but not limited to a detachable magazine;\n(e) \"Law enforcement agency\" means:\n1. Any public agency that employs a law enforcement officer;\n2. Any public agency that is composed of or employs other public peace\nofficers; and\n3. A campus security authority as defined in KRS 164.948 of a public\ninstitution operating under KRS Chapter 164;\n(f) \"Law enforcement officer\" means any \"peace officer\" as defined in KRS\n446.010 and any \"correctional officer\" as defined in KRS 441.045(15)(e);\n(g) \"Local government\" means any city, county, charter county, urban -county,\nconsolidated local, or unified local government; and\n(h) \"Public agency\" has the same meaning as KRS 61.870, including a policy -\nmaking board, or any officer, employee, or entity  of a public institution\noperating under KRS Chapter 164.\n(2) No law enforcement agency, law enforcement officer, employee of a law\nenforcement agency, public agency, public official, employee of a public agency, or\nemployee of a local government shall enf orce, assist in the enforcement of, or\notherwise cooperate in the enforcement of a federal ban on firearms, ammunition,\nor firearm accessories, and shall not participate in any federal enforcement action\nimplementing a federal ban on firearms, ammunition, or firearm accessories.\n(3) No law enforcement agency, local government, or public agency shall adopt a rule,\norder, ordinance, or policy under which the entity enforces, assists in the\nenforcement of, or otherwise cooperates in a federal ban on firearms, ammunition,\nor firearm accessories.\n(4) No local government, employee of a local government, public official, public\nagency, or employee of a public agency shall expend public funds or allocate\nresources for the enforcement of a federal ban on firearms, am munition, or firearm\naccessories.\n(5) A person commits an offense under this section when, while acting in his or her\nofficial capacity under color of law, he or she knowingly violates this section. An\noffense under this section is a Class B misdemeanor for the first offense and a Class\nA misdemeanor for each subsequent offense.\n(6) A person who knowingly commits an offense under this section shall be subject to\ntermination from employment to the extent allowable under state law.\n(7) Nothing in this section  may be interpreted to prohibit or otherwise limit a law\nenforcement agency, law enforcement officer, employee of a law enforcement\nagency, public agency, public official, employee of a public agency, or employee of\na local government from cooperating, com municating, or collaborating with a\nfederal agency if the primary purpose is not:\n(a) Law enforcement activity related to a federal ban on firearm, ammunition, or\nfirearm accessories; or\n(b) The investigation of a violation of a federal ban on firearm, amm unition, or\nfirearm accessories.\n(8) This section shall be retroactive to January 1, 2021.","path":["KRS Chapter 237"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53544","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:50Z","sha256":"758b649f229a5be757d21b803f3857cdaff7a1f2a1d8460384b19b62acfe5bb9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-237.104","next":"us-ky/krs-237.106"},"notice":"GroundRules: Original legal text.
