{"data":{"id":"us-ky/krs-237.118","jurisdiction":"us-ky","citation":"KRS 237.118","heading":"Provisional license -- Criteria -- Application to switch to standard license","body":"upon expiration -- Fee -- Surrender -- Administrative regulations.\n(1) As used in this section:\n(a) \"Provisional license\" means a license to carry concealed firearms  or other\ndeadly weapons issued pursuant to this section; and\n(b) \"Standard license\" means a license to carry concealed firearms or other deadly\nweapons issued pursuant to KRS 237.110.\n(2) The Department of Kentucky State Police shall issue provisional lic enses to carry\nconcealed firearms or other deadly weapons, or a combination thereof, to persons\nwho:\n(a) Are eighteen (18) years of age but younger than twenty -one (21) years of age;\nand\n(b) Notwithstanding KRS 237.110(4)(c), otherwise meet the criteria se t forth in\nKRS 237.110(4) and the requirements of KRS 237.110(3).\n(3) (a) Except as provided in this section, the issuance and regulation of provisional\nlicenses to carry concealed firearms and deadly weapons shall be governed by\nKRS 237.110.\n(b) Any reference in the Kentucky Revised Statutes to a license issued pursuant to\nKRS 237.110 shall also be considered a reference to a provisional license\nissued pursuant to this section.\n(4) A provisional license issued pursuant to this section shall:\n(a) Be valid throughout the Commonwealth and, except as provided in other\nspecific sections of the Kentucky Revised Statutes or federal law, permit the\nholder of the provisional license to carry firearms, ammunition, other deadly\nweapons, or a combination thereof, at any location in the Commonwealth;\n(b) Unless revoked or suspended as provided by law, be valid until the holder\nturns twenty-one (21) years of age;\n(c) Authorize the holder of the pr ovisional license to carry a concealed firearm,\nother deadly weapon, or a combination thereof, on or about his or her person;\nand\n(d) Authorize the holder of the provisional license to carry ammunition for a\nfirearm on or about his or her person.\n(5) A provisional license issued under this section shall be readily distinguishable from\na standard license issued pursuant to KRS 237.110.\n(6) (a) Not less than ninety (90) days before the expiration of the provisional license,\nthe Department of Kentucky State Po lice shall mail to the holder of the\nprovisional license a written notice of the expiration and an application to\nswitch from a provisional license to a standard license. The application to\nswitch from a provisional license to a standard license shall be i n a format\nprescribed by the Department of Kentucky State Police.\n(b) The outside of the envelope shall bear only the name and address of the\napplicant. No other information relating to the applicant shall appear on the\noutside of the envelope sent to the applicant.\n(c) The holder of a provisional license may apply for a standard license by:\n1. Filing with the sheriff of his or her county of residence the paper\napplication form under this subsection, or filing with the Department of\nKentucky State Police an  electronic application form in lieu of a paper\napplication form;\n2. Stating that he or she remains qualified pursuant to the criteria specified\nin KRS 237.110(3) and (4); and\n3. Paying an application fee prescribed by the Department of Kentucky\nState Police.\n(d) The sheriff shall issue to the applicant a receipt for the paper application to\nswitch from a provisional license to a standard license and shall date the\nreceipt. The Department of Kentucky State Police shall issue to the applicant\na receipt for an electronic application to switch from a provisional license to a\nstandard license and shall date the receipt.\n(e) A standard license under KRS 237.110 shall be issued to a qualified applicant\nupon:\n1. Receipt of the completed application to switch from a  provisional\nlicense to a standard license;\n2. Records check as specified in KRS 237.110(3);\n3. Determination that the applicant is not ineligible for a standard license\nas specified in KRS 237.110(4); and\n4. Appropriate payment of fees.\nUpon issuance of the standard license, the provisional license shall be\ndestroyed by the sheriff.\n(f) The holder of a provisional license who fails to submit an application to\nswitch from a provisional license to a standard license within six (6) months\nof the expiration o f the provisional license shall be required to submit an\napplication under KRS 237.110.\n(g) A standard license issued under this subsection shall not be valid until an\napplicant is twenty-one (21) years of age. A provisional licensee who applies\nfor a standard license under this subsection shall not be required to retake the\nfirearms training described in KRS 237.110(4).\n(7) A provisional license which has expired shall be void and shall not be valid for any\npurpose other than surrender to the sheriff in exchange for a standard license.\n(8) The Department of Kentucky State Police may promulgate any necessary\nadministrative regulations in accordance with KRS Chapter 13A to administer this\nsection.","path":["KRS Chapter 237"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58056","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:50Z","sha256":"32b89b145ce1aa76c7b3980880be8ad88118d8bb8fe688c398b1751f4142619e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-237.115","next":"us-ky/krs-237.120"},"notice":"GroundRules: Original legal text.
