{"data":{"id":"us-ky/krs-237.136","jurisdiction":"us-ky","citation":"KRS 237.136","heading":"Suspension or revocation of certification or denial of recertification of","body":"firearms instructor trainer or certified firearms instructor.\n(1) The Department of Criminal Justice Training may suspend or revoke the\ncertification of a firearms instruct or trainer or certified firearms instructor who is\nfound, after a hearing held in conformity with the provisions of KRS Chapter 13B,\nto have violated a statute or administrative regulation relating to the concealed\ndeadly weapon training program. The suspe nsion of a certification may be for a\nperiod not to exceed five (5) years, and the department may require the person\nwhose certification is suspended to successfully complete the level of course\ninstruction for the certification which was suspended prior t o reinstating the\ncertification.\n(2) The department shall deny recertification to a person whose certification has been\nrevoked pursuant to this section.\n(3) The department shall deny recertification to a person whose certification has been\nsuspended for the remaining period of suspension.\n(4) The department may temporarily suspend the certification of a firearms instructor\ntrainer or certified firearms instructor prior to holding a hearing pursuant to KRS\nChapter 13B if the department believes that the safety of the public requires such an\naction. In the event that a certification is temporarily suspended prior to holding a\nhearing pursuant to KRS Chapter 13B, the department shall hold a Chapter 13B\nhearing not later than thirty (30) days from the date of t he temporary suspension\nunless the defendant requests an extension for a time certain. If the defendant\nrequests an extension for a time certain, then the certification shall remain\nsuspended until the conclusion of the hearing.\n(5) A firearms instructor trainer or certified firearms instructor who is the subject of an\ninvestigation shall be notified as required by KRS Chapter 13B and shall have, at all\nstages in the proceeding, the right to be represented by counsel.","path":["KRS Chapter 237"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11142","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:50Z","sha256":"9573bfd445b2c7d16f8271e1690a8bbd61eeab43b595bc4816421097fb390bc5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-237.134","next":"us-ky/krs-237.137"},"notice":"GroundRules: Original legal text.
