{"data":{"id":"us-ky/krs-237.140","jurisdiction":"us-ky","citation":"KRS 237.140","heading":"Certification for retired peace officer to carry concealed deadly weapon --","body":"Administrative regulations -- Requirements -- Firearms instruction.\n(1) (a) Certification for a retired peace officer to carry a concealed deadly weapon\npursuant to KRS 237.138 to 237.142 shall be administered by the Department\nof Kentucky State Police.\n(b) Costs of certification shall be paid for by moneys generated by the concealed\ndeadly weapon license program under KRS 15.383 and collected by the\nDepartment of Kentucky State Police pursuant to that section.\n(c) The Department of Kentucky State Police shall promulgate administrative\nregulations in accordance with KRS Chapter 13A necessary to implement the\nprovisions of KRS 237.138 to 237.142. The regulations shall allow the\nvalidity of any license or certifying documentation issued to the retired peace\nofficer under this section to be extended in yearly increments not more than\nfour (4) times. To facilitate this objective, the regulations may authorize the\nmaterial requir ed by subsection (2) of this section to be submitted to the\nperson supervising the firearms qualifications under subsection (4)(b) of this\nsection, with that person then submitting the material to the Department of\nKentucky State Police and signing the lic ense or certification in a manner that\nsatisfies the requirements of federal law as to the retiree's passage of the\nrequired yearly firearms testing.\n(2) Each retired peace officer who desires certification to carry a concealed deadly\nweapon shall annually submit:\n(a) Evidence of retired status to the commissioner of the Department of Kentucky\nState Police together with all information required by federal law, this section,\nand administrative regulations promulgated pursuant to this section;\n(b) Evidence of  successful completion of firearms qualification required under\nthis section; and\n(c) A notarized statement that he or she is not prohibited by state or federal law\nfrom possessing a firearm.\n(3) Each law enforcement agency that employed the retired peace officer, or at which\nthe retired peace officer served in an elected capacity, shall provide to the retired\nofficer and the Department of Kentucky State Police the information required by\nfederal law, this section, and the administrative regulations promulgated pursuant to\nthis section in a prompt and efficient manner, without charge either to the\nDepartment of Kentucky State Police or the retiree.\n(4) (a) Each retired peace officer shall annually fire twenty (20) rounds at an adult\nsize silhouette target at  a range of twenty -one (21) feet, with a handgun, and\nshall hit the target not less than eleven (11) times to obtain or maintain\ncertification under KRS 237.138 to 237.142.\n(b) The rounds fired pursuant to paragraph (a) of this subsection shall be done\nunder the supervision of:\n1. A firearms instructor of the retiree's former employing agency;\n2. A currently certified peace officer who has successfully completed a\nKentucky Law Enforcement Council approved firearms instructor\ncourse;\n3. A Department of Criminal Justice Training certified police firearms\ninstructor or instructor trainer; or\n4. A Department of Criminal Justice Training certified concealed carry\ninstructor or instructor trainer.\n(c) A firearms instructor may, if not compensa ted pursuant to paragraph (d) of\nthis subsection, charge each participant a fee of not more than twenty dollars\n($20), which shall include the cost of the range, firearms instructor, range\npersonnel, targets, and all other costs associated therewith, but n ot the cost of\nammunition. Ammunition, or the cost of ammunition, shall be provided by the\nretiree.\n(d) A local or state law enforcement agency that desires to conduct firearms\nqualification for its retirees shall schedule not less than two (2) dates for\nfirearms qualification per year, and those dates shall be approximately six (6)\nmonths apart. The local or state law enforcement agency may charge each\nparticipant a fee of not more than twenty dollars ($20), which shall include the\ncost of use of the range , firearms instructor, range personnel, targets, and all\nother costs associated therewith, but not the cost of ammunition. Ammunition,\nor the cost of ammunition, shall be provided by the retiree.\n(e) No employer or appointing authority of a firearms instru ctor who has\nsuccessfully completed a Kentucky Law Enforcement Council approved\nfirearms instructor course, Department of Criminal Justice Training certified\npolice firearms instructor or instructor trainer, or Department of Criminal\nJustice Training certi fied concealed carry instructor or instructor trainer shall\nprohibit or in any way limit the instructor from qualifying active or retired\npeace officers in conformity with KRS 237.138 or 237.142 while that\ninstructor is off duty. No employer or appointing authority of an instructor\nspecified in this paragraph shall be liable in civil damages for the actions or\nomissions of the instructor during qualification of active or retired peace\nofficers when that instructor is off duty.","path":["KRS Chapter 237"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43446","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:50Z","sha256":"42141b769a41636a34ef4ecf89b9226c539fd69bed0be1660119601057576354","source_id":"us-ky","stale":false,"prev":"us-ky/krs-237.138","next":"us-ky/krs-237.142"},"notice":"GroundRules: Original legal text.
