{"data":{"id":"us-ky/krs-237.150","jurisdiction":"us-ky","citation":"KRS 237.150","heading":"Definitions for section -- Prohibitions on merchant category codes.","body":"(1) As used in this section:\n(a) \"Ammunition\" has the same meaning as in 18 U.S.C. sec. 921(a)(17)(A), as\namended;\n(b) \"Covered entity\" means any entity that establishes a re lationship with a\nretailer for the purposes of processing credit, debit, or prepaid transactions;\n(c) \"Firearm\" means any of the following as defined in 18 U.S.C. sec. 921, as\namended:\n1. A \"firearm\";\n2. A \"shotgun\";\n3. A \"rifle\"; and\n4. An \"antique firearm\";\n(d) \"Firearms retailer\" means a person or entity that is:\n1. Physically located in Kentucky; and\n2. Engaged in the lawful business of selling or trading firearms or\nammunition;\n(e) \"Merchant category code\" means a code assigned to a retailer based on the\ntypes of goods and services offered to a retailer's customers; and\n(f) \"Payment card network\":\n1. Means any entity that, directly or through a member, processor, or\nagent, provides p roprietary services, infrastructure, software, or\nhardware that routes information used to authorize, clear, and settle\ncredit, debit, or prepaid transactions; and\n2. Does not include a financial institution that settles a credit, debit, or\nprepaid transaction directly with a retailer on behalf of a consumer.\n(2) A payment card network shall not require or incentivize the use of a merchant\ncategory code that distinguishes a firearms retailer from other retailers.\n(3) A covered entity or its agent shall not assign a firearms retailer any merchant\ncategory code that distinguishes the firearms retailer from other retailers, including\nthe assigning of merchant category code 5723, approved in September 2022 by the\nInternational Organization for Standardization, to firearms retailers.","path":["KRS Chapter 237"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54765","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:50Z","sha256":"6e3b54ae6e3a1a135d38646e70c75e852dd8317ca043a37e69139c6ee2672764","source_id":"us-ky","stale":false,"prev":"us-ky/krs-237.142","next":"us-ky/krs-237.152"},"notice":"GroundRules: Original legal text.
