{"data":{"id":"us-ky/krs-238.505","jurisdiction":"us-ky","citation":"KRS 238.505","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context requires otherwise:\n(1) \"Adjusted gross receipts\" means gross receipts from the conduct of charitable\ngaming less all cash prizes and the amount paid for merchandise prizes purchased;\n(2) \"Affiliate\" means any co rporation, partnership, association, or other business or\nprofessional entity or any natural person that directly or indirectly, through one or\nmore intermediaries, controls, or is controlled by, or is under common control with\na licensed manufacturer, distributor, or charitable gaming facility;\n(3) \"Bingo\" means a specific game of chance in which participants use cards or paper\nsheets, or card -minding device representations thereof, divided into horizontal and\nvertical spaces, each of which is designated b y a letter and a number, and prizes are\nawarded on the basis of the letters and numbers on the card conforming to a\npredetermined and preannounced configuration of letters and numbers selected at\nrandom;\n(4) \"Board\" means the board of directors of the Kent ucky Horse Racing and Gaming\nCorporation;\n(5) \"Card-minding device\" means any mechanical, electronic, electromechanical, or\ncomputerized device that is interfaced with or connected to equipment used to\nconduct a game of bingo and that allows a player to store, display, and mark a bingo\ncard face. A card -minding device shall not be designed and manufactured to\nresemble any electronic gaming device that utilizes a video display monitor, such as\na video lottery terminal, video slot machine, video poker machine , or any similar\nvideo gaming device;\n(6) (a) \"Chairperson\" means:\n1. The chief executive officer and any officer, member, or employee of a\nlicensed charitable organization; or\n2. An employee of the premises upon which the charitable gaming is\nconducted that is twenty -one (21) years of age or older, has completed\ntraining prescribed by the office, and has completed the required\nbackground checks;\nwho will be involved in the management and supervision of charitable gaming\nas designated in the organization's charitable gaming license application under\nKRS 238.535(13)(g).\n(b) Training prescribed by the office in paragraph (a) of this subsection and the\nfederal background check required in KRS 238.525 shall not be in effect until\nJuly 1, 2027;\n(7) \"Charitable gaming\" means bingo, charity game tickets, raffles, and charity\nfundraising events conducted for fundraising purposes by charitable organizations\nlicensed and regulated under the pr ovisions of this chapter. \"Charitable gaming\"\nshall not include slot machines, electronic video gaming devices, wagering on live\nsporting events, or simulcast broadcasts of horse races;\n(8) \"Charitable gaming facility\" means a person, including a licensed charitable\norganization, that owns or is a lessee of premises which are leased or otherwise\nmade available to two (2) or more licensed charitable organizations, other than\nitself, during a one (1) year period for the conduct of charitable gaming;\n(9) \"Charitable gaming supplies and equipment\" means any material, device, apparatus,\nor paraphernalia customarily used in the conduct of charitable gaming, including\nbingo cards and paper, charity game tickets, and other apparatus or paraphernalia\nused in conducti ng games of chance at charity fundraising events subject to\nregulation under this chapter. The term shall not include any material, device,\napparatus, or paraphernalia incidental to the game, such as pencils, daubers, playing\ncards, or other supplies that may be purchased from normal sources of supply;\n(10) \"Charitable organization\" means a nonprofit entity organized for charitable,\nreligious, educational, literary, civic, fraternal, or patriotic purposes;\n(11) \"Charity fundraising event\" means an activity of limited duration at which games of\nchance approved by the corporation are conducted, including bingo, raffles, charity\ngame tickets, special limited charitable games, and wagering on prerecorded horse\nraces, KRS Chapter 230 notwithstanding. Examples of such activities include\nevents that attract patrons for community, social, and entertainment purposes apart\nfrom charitable gaming, such as fairs, festivals, carnivals, licensed charitable\ngaming organization conventions, bazaars, and banquets. For the pur poses of this\nsubsection, \"banquet\" shall mean a formal meal or feast held by a charitable\norganization for community, social, or entertainment purposes apart from charitable\ngaming;\n(12) \"Charity game ticket\" means a game of chance using a folded or bande d paper\nticket, or a paper card with perforated break -open tabs, or electronic pulltab device\nrepresentations thereof, the face of which is covered or otherwise hidden from view\nto conceal a number, letter, symbol, or set of numbers, letters, or symbols, s ome of\nwhich have been designated in advance as prize winners and shall include charity\ngame tickets that utilize a seal card. \"Charity game ticket\" shall include pulltabs,\nboth paper and electronic representations thereof;\n(13) \"Corporation\" means the Kentucky Horse Racing and Gaming Corporation;\n(14) \"Distributor\" means a person who sells, markets, leases, or otherwise furnishes to a\ncharitable organization charitable gaming equipment or supplies, or both, used in\nthe conduct of charitable gaming. \"Distributor\" shall not include:\n(a) A resident printer who prints raffle tickets at the request of a licensed\ncharitable organization; and\n(b) A licensed charitable organization that affects a one -time donation of\ncharitable gaming supplies or equipment to anoth er licensed charitable\norganization if the donation is first approved by the corporation;\n(15) \"Door prize\" means a prize awarded to a person based solely upon the person's\nattendance at an event or the purchase of a ticket to attend an event;\n(16) \"Electronic pulltab device\" means an electronic device used only for charitable\ngaming to facilitate the play of an electronic pulltab. An electronic pulltab device\nshall be a tablet or other personal computing device, other than a mobile phone or\nsimilar handhel d device, as approved by the corporation. An electronic pulltab\ndevice may only operate on a closed network or intranet that is confined to the\nlicensee's premises, and shall not be internet accessible by patrons, but shall be\nconnected to a central server  system solely for the purposes of monitoring,\nreporting, accounting, and software maintenance. An electronic pulltab device shall\nnot be designed and manufactured to resemble any electronic gaming device that\nutilizes a video display monitor, such as a vi deo lottery terminal, video slot\nmachine, video poker machine, or any similar video gaming device;\n(17) \"Electronic video gaming device,\" as used in this chapter and the related\nadministrative regulations, means any device that possesses a video display a nd\ncomputer mechanism for playing a game. Electronic video gaming device shall not\nmean any electronic representation of charitable gaming games identified, defined,\nand approved by statute and by administrative regulation of the corporation;\n(18) \"Gross r eceipts\" means all moneys collected or received from the conduct of\ncharitable gaming;\n(19) \"Immediate family\" means:\n(a) Spouse and parents-in-law;\n(b) Parents and grandparents;\n(c) Children and their spouses; and\n(d) Siblings and their spouses;\n(20) \"Manufacturer\" means a person who assembles from raw materials or subparts any\ncharitable gaming equipment or supplies used in the conduct of charitable gaming,\nincluding a person who converts, modifies, and adds to or removes parts from,\ncharitable gaming equipment and supplies. The term shall not include:\n(a) Any person who services or repairs charitable gaming supplies and\nequipment, so long as that person replaces or repairs an incidental,\nmalfunctioning, or nonfunctioning part with a similar or identical part; and\n(b) Any distributor who cuts, collates, and packages for distribution any gaming\nsupplies and equipment purchased in bulk;\n(21) \"Net receipts\" means adjusted gross receipts from the conduct of charitable gaming\nless all expenses, charges, fees, and deductions authorized under this chapter;\n(22) \"Office\" means the office regulating charitable gaming within the Kentucky Horse\nRacing and Gaming Corporation established by the president under KRS Chapter\n230;\n(23) \"President\" means the president of the Kentucky Horse Racing and Gaming\nCorporation;\n(24) \"Raffle\" means a game of chance in which a participant is required to purchase a\nticket for a chance to win a prize, with the winner to be determined by a random\ndrawing;\n(25) \"Seal card\" means a board or placard used in conjunction with charity game tickets,\nthat contains a seal or seals which, when removed or opened, reveal predesignated\nwinning numbers, letters, or symbols;\n(26) \"Session\" or \"bingo session\" means a single gathering at which a bingo game or\nseries of successive bingo games are played, excluding bingo played at a charity\nfundraising event;\n(27) \"Special limited charitable game\" means roulette; blackjack; poker; keno; money\nwheel; baccarat; pusher -type games; any dice game where the player competes\nagainst the house; and any other game of chance as identified, defined, and\napproved by administrative regulation of the corporation;\n(28) \"Special limited charity fundraising event\" means any type of charity fundraising\nevent, commonly known as and operated as a \"casino night,\" \"Las Vegas night,\" or\n\"Monte Carlo night,\" at which the predominant number or types of games offered\nfor play are special limited charitable games; and\n(29) \"Year\" means calendar year e xcept as used in KRS 238.535(11), 238.545(4),\n238.547(1), and 238.555(7), when \"year\" means the licensee's license year.","path":["KRS Chapter 238"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58111","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:51Z","sha256":"77c102c2eada825ae5ee12e6cfcbd3c8eab8b8036efd88e0083a768cdcbf59e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-238.500","next":"us-ky/krs-238.510"},"notice":"GroundRules: Original legal text.
