{"data":{"id":"us-ky/krs-238.515","jurisdiction":"us-ky","citation":"KRS 238.515","heading":"Powers and duties of office.","body":"Charitable gaming shall not be conducted in the Commonwealth except as authorized by\nthis chapter and KRS Chapter 230. The office shall license and regulate the conduct of\ncharitable gaming in the Commonwealth of Kentucky as authorized by the corporation.\nThe president may integrate office responsibilities into other corporation offices to ensure\nefficiencies and eliminate duplication of duties. Office powers and duties include:\n(1) Licensing charitable organizations, charitable gaming facilities, manufactu rers, and\ndistributors that desire to engage in charitable gaming;\n(2) Refusing to issue or renew a license for cause, revoking or suspending a license,\nimposing probationary conditions on a license, issuing a written reprimand or\nadmonishment or notice of  violation, and imposing fines and penalties, or any\ncombination thereof with regard to a licensee or other person participating in\ncharitable gaming in Kentucky for violation of any federal or state statute or\nadministrative regulation, or office directiv e, ruling, or order to preserve the\nintegrity of charitable gaming in Kentucky or to protect the public from direct\nharm;\n(3) Establishing and enforcing reasonable standards for the conduct and operation of\ncharitable gaming activity and the operation of charitable gaming facilities;\n(4) Prescribing reasonable fees for licenses that do not exceed amounts established in\nthis chapter;\n(5) Establishing standards of accounting, recordkeeping, and reporting to insure\ncharitable gaming receipts are properly accounted for;\n(6) Establishing a process for reviewing complaints and allegations of wrongdoing, and\nfor investigating complaints with merit. In furtherance of this duty, the office may\nissue administrative subpoenas and summonses. The office shall also establ ish toll-\nfree telephone service or an electronic method for receiving complaints and\ninquiries;\n(7) Investigating, auditing, and other reasonable actions to ensure compliance with this\nchapter;\n(8) Taking appropriate disciplinary action, subject to the fin al order of the corporation,\nand making referrals for criminal prosecution of persons who do not operate in\ncompliance with this chapter;\n(9) Collecting and depositing all fees and fines in the charitable gaming regulatory\naccount to be administered by the corporation; and\n(10) Proposing administrative regulations in accordance with KRS Chapter 13A which\nare necessary to carry out the purposes and intent of this chapter.
