{"data":{"id":"us-ky/krs-238.555","jurisdiction":"us-ky","citation":"KRS 238.555","heading":"Charitable gaming facility license -- Fee -- Lease agreements for use of","body":"facility -- Quarterly reports -- Number of events that may be held -- Display of\nlicense and charitable organization's name.\n(1) (a) A person shall not opera te a charitable gaming facility unless the person is\nlicensed under the provisions of this chapter, except that facilities that only\nhost charity fundraising events shall be exempt from licensure.\n(b) The office shall charge a license fee not to exceed fi ve thousand dollars\n($5,000). Specific license fees to be charged shall be:\n1. Prescribed in a graduated scale promulgated by administrative\nregulation; and\n2. Based on the number of sessions which the facility holds per week or\nother applicable factors or combination of factors.\n(c) Charitable gaming may be conducted in a charitable gaming facility only by a\nlicensed charitable organization in accordance with the provisions of this\nchapter.\n(2) In the application process, an applicant for a charitable ga ming facility license shall\nsubmit the following information:\n(a) The address of the facility;\n(b) A description of the facility to include square footage of the gaming area,\ncapacity levels, and available parking;\n(c) The applicant's ability to manage and operate the charitable gaming facility\nand comply with all applicable standards;\n(d) The names, ad dresses, dates of birth, and Social Security numbers of all\nindividuals employed by or contracted with the applicant to manage the\nfacility or provide other authorized services;\n(e) The name, address, date of birth, and Social Security number of any\nindividual who has a ten percent (10%) or greater financial interest in the\nfacility;\n(f) A copy of the lease agreement used by the applicant; and\n(g) Any other information the office deems appropriate.\n(3) An owner, officer, employee, or contractee of a license d charitable gaming facility\nor an affiliate, or any member of the immediate family of any officer, employee, or\ncontractee of a licensed charitable gaming facility or an affiliate shall not,\nconcerning a lessee:\n(a) Manage or otherwise be involved in the conduct of charitable gaming;\n(b) Provide bookkeeping or other accounting services related to the conduct of\ncharitable gaming;\n(c) Handle any moneys generated in the conduct of charitable gaming;\n(d) Advise a licensed charitable organization on the expenditure of net receipts;\n(e) Provide transportation services in any manner to patrons of a charitable\ngaming activity;\n(f) Solicit licensed charitable organizations to participate in the conduct of\ncharitable gaming at the charitable gaming facility in order  to profit from the\nconduct of charitable gaming;\n(g) Provide advertisement or marketing services in any manner to a licensed\ncharitable organization;\n(h) Provide, coordinate, or solicit the services of personnel or volunteers in any\nmanner;\n(i) Influence or require a licensed charitable organization to use a certain\ndistributor or any particular gaming supplies; or\n(j) Donate or give any prize to be awarded in the conduct of charitable gaming.\n(4) A licensed charitable gaming facility shall execute a lease  agreement with each\nlicensed charitable organization that desires to conduct charitable gaming at the\nfacility. The amount of rent, goods, and services charged shall be reasonable and\nshall be based on prevailing market values in the general locality for the goods and\nservices to be provided. The amount charged to rent a charitable gaming facility,\nwhether the facility is licensed or unlicensed, shall be a fixed fee and not be based\nin whole or in part on a percentage of gross receipts, net proceeds derive d from the\nconduct of charitable gaming, or by reference to the number of people in\nattendance. A licensed charitable gaming facility shall file a copy of each signed\nlease agreement with the office.\n(5) The number of bingo sessions conducted at a charitab le gaming facility shall be\nlimited to the following:\n(a) No more than eighteen (18) sessions per week if the charitable gaming facility\nis located in one (1) of the following:\n1. A city containing a population equal to or greater than twenty thousand\n(20,000) based upon the most recent federal decennial census;\n2. An urban-county government;\n3. A consolidated local government;\n4. A charter county government; or\n5. A county containing a city of the first class or a city containing a\npopulation equal to or greater than twenty thousand (20,000) based upon\nthe most recent federal decennial census; or\n(b) No more than eight (8) sessions per week if the charitable gaming facility is\nlocated in a city other than those listed in paragraph (a) of this subsection, or\nin a county that does not contain a city that is listed in paragraph (a) of this\nsubsection.\n(6) A licensed charitable gaming facility shall report at least quarterly to the office and\nshall provide any information concerning its operation that the office may require.\n(7) A charity fundraising event at which special limited charitable games are played\nmay be conducted at a licensed charitable gaming facility, but no licensed\ncharitable gaming facility shall be permitted to hold more than one (1) such event\nper week or more than seven (7) per year.\n(8) A licensed charitable gaming facility shall conspicuously display a sign bearing the\nname and the license number of the charitable organization that is conducting\ncharitable gaming activities in the facility.\n(9) The license to operate the charitable gaming facility shall be prominently displayed\non or in the premises where charitable gaming activity is being conducted, in a\nconspicuous location that is readily accessible to gaming patrons as well as\nemployees of the office, law enforcement officials, and other interested officials.","path":["KRS Chapter 238"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58120","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:51Z","sha256":"d55c20985d2c4524134c768176a7b400aa0f7cba04ece543ec303b485762aef3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-238.550","next":"us-ky/krs-238.560"},"notice":"GroundRules: Original legal text.
