{"data":{"id":"us-ky/krs-23a.208","jurisdiction":"us-ky","citation":"KRS 23A.208","heading":"Additional fee for sex crime, stalking, or related inchoate offenses.","body":"(1) In addition to fees created by KRS 23A.205, 23A.206, and 23A.2065, an\nadministrative fee of thirty dollars ($30) shall be added to the costs that the\ndefendant is required to pay for the following crimes:\n(a) A sex crime, meaning an offense described in:\n1. KRS Chapter 510;\n2. KRS 530.020;\n3. KRS 530.064(1)(a);\n4. KRS 531.310; and\n5. KRS 531.320;\n(b) Stalking, meaning conduct prohibited under KRS 508.130; and\n(c) A criminal attempt, conspiracy, facilitation, or solicitation to commit the\ncrimes set forth in this subsection.\n(2) The first one dollar and fifty cents ($1.50) of each fee collected under this section\nshall be placed into the general fund, and the remain der of the fee shall be allocated\nby the clerk of the court on a quarterly basis to the Safe at Home Program fund\nestablished in KRS 14.260 to be used solely to establish, operate, and maintain the\nSafe at Home Program established in KRS 14.302.\n(3) The court may waive all or any portion of the fee required by this section if the\ncourt finds that a person subject to the surcharge is indigent or financially unable to\npay all or any portion of the surcharge.
