{"data":{"id":"us-ky/krs-242.021","jurisdiction":"us-ky","citation":"KRS 242.021","heading":"Restriction on frequency of request to increase quota retail licenses --","body":"Publication of notice of request -- Contents of request -- Burden on requestor\nto show that increase is necessary.\n(1) A city, including a city located in a wet or dry cou nty, county, or urban -county\ngovernment authorized by this section shall not file a request with the board seeking\nto increase the number of quota retail package licenses for the city, county, or\nurban-county government unless at least one (1) year has pas sed since the\ncertification of the local option election approving alcohol sales that resulted in the\nestablishment of the quota retail package license number that the city, county, or\nurban-county government seeks to have increased.\n(2) Prior to making it s request, the city, county, or urban -county government shall\npublish a notice in the newspaper used for its legal notices, advising the general\npublic of the city's, county's, or urban -county government's intent to request\nadditional licenses from the board.\n(3) The request to the board for a quota increase shall include:\n(a) A certified copy of the governing body's resolution approving the request;\n(b) A certified copy of the notice referenced in subsection (2) of this section; and\n(c) An explanation as to the reason the city, county, or urban -county government\nmeets the criteria established in KRS 241.069 for a quota increase.\n(4) The city, county, or urban -county government shall bear the burden of showing an\nincrease is necessary.\n(5) A city, county, or  urban-county government shall not petition the board for an\nincrease more than once every three (3) years.","path":["KRS Chapter 242"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54477","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"74bcfb7ed7b7ed384d75f3ba68a29b497e97dbaff9a75ec9a44956b2eacf5af1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-242.020","next":"us-ky/krs-242.022"},"notice":"GroundRules: Original legal text.
