{"data":{"id":"us-ky/krs-242.122","jurisdiction":"us-ky","citation":"KRS 242.122","heading":"Local option election for sale of alcoholic beverages in precinct where a","body":"marina is located -- Petition language.\n(1) (a) To promote economic development and tourism in any dry or moist county or\ncity in which a marina is located, a local opt ion election for the sale of\nalcoholic beverages may be held in a city or county precinct where the marina\nis located, notwithstanding any other provision of the Kentucky Revised\nStatutes to the contrary.\n(b) A petition seeking a local option election unde r this section shall state \"We\nthe undersigned registered voters hereby petition for an election on the\nfollowing question: 'Are you in favor of the sale of alcoholic beverages by the\ndrink and malt beverages by the package at marinas located in (name of\nprecinct)?'\".\n(2) A local option election for the sale of alcoholic beverages held under subsection (1)\nof this section shall be conducted in the same manner as specified in KRS 242.020,\n242.040, 242.060, 242.070, 242.090, 242.110, and 242.120. The form of the\nproposition to be voted upon shall be \"Are you in favor of the sale of alcoholic\nbeverages by the drink and malt beverages by the package at marinas located in the\n(name of precinct)?\".\n(3) When a majority of the votes cast in an election held under su bsections (1) and (2)\nof this section are in favor of establishing moist territory, the premises of the\nmarinas located in that precinct shall become moist in the manner specified in KRS\n242.200.\n(4) The election shall not be deemed to be an election in th e \"same territory\" within the\nmeaning of KRS 242.030(3).","path":["KRS Chapter 242"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55131","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"533c9de378bcf125a9eccb38e576672bebb9d9967a0e38458a8c9ef727b7ea6c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-242.120","next":"us-ky/krs-242.123"},"notice":"GroundRules: Original legal text.
