{"data":{"id":"us-ky/krs-242.1239","jurisdiction":"us-ky","citation":"KRS 242.1239","heading":"Local option election for sale of alcoholic beverages by a microbrewery in","body":"the territory where the microbrewery is located or proposed.\n(1) In order to promote economic development and tourism, a dry or moist city, county,\nurban-county government, charter county, consolidated local government, or unified\nlocal government may hold a local option election on the sale of alcoholic\nbeverages by a microbrewery in the territory where the microbrewery is located or\nproposed.\n(2) A petition seeking a  local option election under this subsection shall state \"We the\nundersigned registered voters hereby petition for an election on the following\nquestion: 'Are you in favor of the sale of alcoholic beverages at a microbrewery\nlocated in (name of precinct)?'\"\n(3) The local option election shall be held in accordance with KRS 242.020 to 242.040,\nand 242.060 to 242.120. The form of the proposition to be voted upon shall be:\n\"Are you in favor of the sale of alcoholic beverages at a microbrewery located in\n(name of precinct)?\" If the majority of the votes in an election held pursuant to this\nsubsection are \"Yes,\" the precinct shall become moist in the manner specified in\nKRS 242.200, and a nonquota type 4 retail malt beverage drink license and a\nnonquota retail ma lt beverage package license may be issued to a microbrewer\nlocated within the precinct.","path":["KRS Chapter 242"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50396","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"058f5700e39407eb7301765befa339e9d2a6a2de5662369a2ed8c488afc97eb3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-242.1238","next":"us-ky/krs-242.124"},"notice":"GroundRules: Original legal text.
