{"data":{"id":"us-ky/krs-242.1244","jurisdiction":"us-ky","citation":"KRS 242.1244","heading":"Local option for limited sale of alcoholic beverages purchased  in","body":"conjunction with a meal -- Separate local option elections to be held for\nrestaurants seating fifty persons and those seating one hundred persons.\n(1) (a) In order to promote economic development and tourism, a dry or moist\ncity, county, urban county government, charter county, consolidated local\ngovernment, or unified local government may hold a local option election\non the sale of alcoholic beverages by the drink at restaurants that seat a\nminimum  of fifty (50) persons and derive a minimum  of seventy percent\n(70%) of their food and alcoholic beverage receipts from the sale of food if\nalcoholic beverages are purchased in conjunction with a meal. A petition\nseeking a local option election under this subsection shall state \"We the\nundersigned registered voters hereby petition for an election on the\nfollowing question: 'Are you in favor of the sale of alcoholic beverages by\nthe drink at restaurants with a seating capacity of at least fifty (50)\npersons and which derive at least seventy percent (70%) of their food and\nalcoholic beverage receipts from the sale of food if the alcoholic beverage\nis purchased in conjunction with a meal?'\".\n(b) The local option election shall be held in accordance with KRS 242.020 to\n242.040, and 242.060 to 242.120. The form of the proposition to be voted\nupon shall be: \"Are you in favor of the sale of alcoholic beverages by the\ndrink in (name of city or county) at restaurants with a seating capacity of\nat least fifty (50) persons and which derive at least seventy percent (70%)\nof their food and alcoholic beverage receipts from the sale of food if the\nalcoholic beverage is purchased in conjunction with a meal?\". If the\nmajority of the votes in an election held pursuant to this subsection are\n\"Yes,\" licenses may be issued to qualified restaurants.\n(2) (a) In order to promote economic development and tourism, a dry or moist\ncity, county, urban-county government, charter county, consolidated local\ngovernment, or unified local government may hold a local option election\non the sale of alcoholic beverages by the drink at restaurants and dining\nfacilities which seat a minimum of one hundred (100) persons and derive\na minimum of seventy percent (70%) of their food and alcoholic beverage\nreceipts from the sale of food.\n(b) A petition seeking a local option election under this subsection shall state\n\"We  the undersigned registered voters hereby petition for an election on\nthe following question: 'Are you in favor of the sale of alcoholic beverages\nby the drink in (name of city or county) at restaurants and dining facilities\nwith a seating capacity of at least one hundred (100) persons and which\nderive at least seventy percent (70%) of their food and alcoholic beverage\nreceipts from the sale of food?'\".\n(c) The local option election shall be held in accordance with KRS 242.020 to\n242.040, and 242.060 to 242.120. The form of the proposition to be voted\nupon shall be: \"Are you in favor of the sale of alcoholic beverages by the\ndrink in (name of city or county) at restaurants and dining facilities with a\nseating capacity of at least one hundred (100) persons and which derive\nat least seventy percent (70%) of their food and alcoholic beverage\nreceipts from the sale of food?\". If the majority of the votes in an election\nheld pursuant to this subsection are \"Yes,\" licenses may  be issued to\nqualified restaurants and dining facilities.\n(3) A  local option proposition under subsection (1) of this section is a separate\nproposition than a local option proposition held under subsection (2) of this\nsection, so that a separate limited local option election under each subsection\nis permitted. A  territory may, by separate limited local option elections,\nsimultaneously allow alcoholic beverage sales under subsections (1) and (2) of\nthis section.
