{"data":{"id":"us-ky/krs-242.195","jurisdiction":"us-ky","citation":"KRS 242.195","heading":"Vote for prohibition in precinct of a city with population of 12,000 or more","body":"to be applied precinct-wide -- Exemptions.\n(1) Notwithstanding KRS 242.125, when the voters of any precinct located either\npartially or entirely within a qualifying city make KRS 242.220 to 242.430 apply to\nthe precinct, the provisions of KRS 242.220 to 242.430 shall apply throughout the\nentire territory of the precinct, except in any area exempted under subsection (2) of\nthis section. For purposes of this section, a \"qualif ying city\" means a city that\ncontains a total population of twelve thousand (12,000) or greater within its\nmunicipal boundaries, based on the most recent decennial census.\n(2) The provisions of KRS 242.220 to 242.430 shall not apply to any of the following\nthat existed in a precinct prior to the submission of a petition under KRS 242.020\nfor that precinct:\n(a) An entertainment destination center project meeting the qualifications of KRS\n148.853(2)(b);\n(b) A theme restaurant destination attraction project me eting the qualifications of\nKRS 148.853(2)(c); or\n(c) Within the established boundaries of a district of special interest created by\nthe city pursuant to the provisions of KRS 100.203(1)(e) that:\n1. Is designated as an entertainment district; and\n2.  Has a  minimum direct investment by the city government in\ninfrastructure or other public space of at least five million dollars\n($5,000,000).\n(3) The boundaries of a district of special interest meeting the qualifications of\nsubsection (2)(c) of this section sh all not be enlarged or modified to include any\nadditional territory at any time after the submission of a petition under KRS\n242.020 unless the voters of the precinct do not make KRS 242.220 to 242.430\napply to the precinct.","path":["KRS Chapter 242"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41802","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"568a83b68073af5514c593efb21fc15dce92c83fcdfdab9c8f2dfa0c1dae5565","source_id":"us-ky","stale":false,"prev":"us-ky/krs-242.190","next":"us-ky/krs-242.200"},"notice":"GroundRules: Original legal text.
