{"data":{"id":"us-ky/krs-242.250","jurisdiction":"us-ky","citation":"KRS 242.250","heading":"Distributing, soliciting or receiving contracts or orders in dry territory","body":"prohibited, when -- Same prohibition on contracts or orders to any moist\nterritory unless sale of alcoholic beverages specifically authorized under\nlimited local option el ection -- Immunity for licensed common carriers --\nAbsolute defense.\n(1) No person, while representing either the buyer or seller, shall distribute, solicit, or\nreceive contracts, proposals, or orders for the purchase or sale of any alcoholic\nbeverages, or distribute any handbills or posters advertising them in dry territory.\n(2) Each act of distributing, soliciting, or receiving contracts, proposals, or orders as\ndenounced in subsection (1), and each day in which advertising matter is\ndistributed, shall constitute a separate offense.\n(3) This chapter shall not prevent any manufacturer of or wholesale dealer in alcoholic\nbeverages, or any authorized agent of either from making contracts of barrel, case,\nor package lots in any dry or moist territory, if his  or her distilleries, breweries,\nwineries, or warehouses are located in that territory and his or her products are to be\nshipped into territory, either within or without the state, where alcoholic beverages\nmay lawfully be sold.\n(4) Subsections (1) and (2)  of this section shall also apply to moist territory unless the\nsale of the alcoholic beverage in question has been specifically authorized in that\nmoist territory under a limited local option election.\n(5) No properly licensed common carrier or any of its  employees acting on behalf of a\nconsignor shall be liable for a violation of this section.\n(6) Proof that the purchaser represented in writing that the delivery address is located in\nwet territory shall be an absolute defense to a violation of this sectio n on behalf of a\nretailer, winery, small farm winery, or distillery in connection with the delivery or\nshipment of alcoholic beverages purchased at retail.","path":["KRS Chapter 242"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47271","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"477b33e0535ed1df006f6eb9003928dd8309147210274129c772de55a19521b4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-242.240","next":"us-ky/krs-242.260"},"notice":"GroundRules: Original legal text.
