{"data":{"id":"us-ky/krs-242.270","jurisdiction":"us-ky","citation":"KRS 242.270","heading":"C.O.D. shipments of alcoholic beverages in dry territory prohibited --","body":"Same prohibition on C.O.D. shipments to any moist territory unless sale of\nalcoholic beverages specifically authorized under limited local option election -\n- Immunity for common carriers -- Absolute defense.\n(1) No person shall sell or deliver any alcoholic beverages that are to be paid for on\ndelivery, in dry territory.\n(2) Such transactions shall be deemed sales at the place where the money is paid or the\ngoods delivered.\n(3) This section shall also apply to the sale or delivery of any alcoholic beverages that\nare to be paid for on delivery in moist territory unless the sale of the alcoholic\nbeverage in question has been specifically authorized in that moist territory under a\nlimited local option election.\n(4) No properly licensed common carrier or any of its employees acting on behalf of a\nconsignor shall be liable for a violation of this section.\n(5) Proof that the purchaser represented in writing that the delivery address is located in\nwet territory shall be an absolute defense to a violation of this section on behalf of a\nretailer, winery, small farm winery, or distillery in connection with the delivery or\nshipment of alcoholic beverages purchased at retail.","path":["KRS Chapter 242"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47273","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"59a188640906af726bb9b4af9b795566d83f527bd6736f7d1e13a49b365e7a7f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-242.260","next":"us-ky/krs-242.280"},"notice":"GroundRules: Original legal text.
