{"data":{"id":"us-ky/krs-242.330","jurisdiction":"us-ky","citation":"KRS 242.330","heading":"Sale of forfeited property and disposition of proceeds.","body":"(1) Upon a judgment of forfeiture under KRS 242.320, the court shall direct the sheriff\nto sell the property. The sale shall be made in the same manner as sales under\nexecution, and the same fees shall be allowed the officers conducting the sale.\n(2) The sheriff shall pay first out of the purchase money any valid recorded liens on the\nproperty so sold. The court may in its discretion order a sale subject to the liens.\n(3) No lien on any property so sold shall be paid unless it is recorded prior to the\ncommitting of the nuisance and unless the lienor can establish he had no knowledge\nof the nuisance.\n(4) If the petition is filed by a private citizen and a sale ordered, the citizen shall receive\nten percent (10%) of the net proceeds of sale of any property under any judgment of\nforfeiture, after deducting costs and all valid liens.\n(5) The sheriff, after payment of liens, costs and fees, shall pay the balance of the\nproceeds of sale to the circuit clerk, who shall transmit the balance as in the case of\nother forfeitures.","path":["KRS Chapter 242"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11289","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"64bff63ecc7485e0e8ab7a6a6b258a43b32e24fb27a691960ae7c05a7b015fb6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-242.320","next":"us-ky/krs-242.340"},"notice":"GroundRules: Original legal text.
