{"data":{"id":"us-ky/krs-242.350","jurisdiction":"us-ky","citation":"KRS 242.350","heading":"Court may enjoin nuisance.","body":"(1) If it is made to appear to the satisfaction of the court that a nuisance described by\nKRS 242.310 exists, a temporary injunction shall forthwith issue, restraining the\ndefendant from conducting or permitting the continuance of the nuisance until the\nconclusion of the trial. If a temporary injunction is prayed for, the court may issue\nan order restraining all persons from interfering in any way with the alcoholic\nbeverages, fixtures or other things used in connection with the nuisance.\n(2) It shall not be ne cessary for the court to find the property involved is being\nunlawfully used as described in KRS 242.310 at the time of the hearing, but on\nfinding that the material allegations of the petition are true, the court shall order that\nno alcoholic beverages sh all be sold, bartered or stored on the premises or vehicle,\nor any part thereof. Upon judgment of the court ordering the nuisance abated, the\ncourt may order that the premises or vehicle shall not be occupied or used for six (6)\nmonths.\n(3) The court may permit the premises or vehicle to be used if the owner, lessee, tenant\nor occupant gives bond with sufficient surety, to be approved by the court making\nthe order, in the sum of not less than five hundred dollars ($500) nor more than one\nthousand dollars ($ 1,000), payable to the state and conditioned that alcoholic\nbeverages will not thereafter be sold, bartered, kept or otherwise disposed of on or\nin the premises or vehicle, and that he will pay all fines, costs and damages that may\nbe assessed for any violation of this chapter on or in the premises or vehicle.","path":["KRS Chapter 242"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=11291","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"80b314d5ff6ae4c8594f131283e4e346d8d63bb7db239f26d5db2f4a05fb64ca","source_id":"us-ky","stale":false,"prev":"us-ky/krs-242.340","next":"us-ky/krs-242.360"},"notice":"GroundRules: Original legal text.
