{"data":{"id":"us-ky/krs-243.020","jurisdiction":"us-ky","citation":"KRS 243.020","heading":"License required -- Federal license presumptions -- Alcoholic beverages","body":"and cannabis -infused beverages not purchased from licensee disallowed on\nlicensed premises -- Licenses permitted in moist territory -- Possession of\nalcohol on or near licens ed entertainment destination center premises\npermitted.\n(1) A person shall not do any act authorized by any kind of license with respect to the\nmanufacture, storage, sale, purchase, transporting, or other traffic in alcoholic\nbeverages or the distrib ution, retail sale, or transportation of cannabis -infused\nbeverages unless the person holds or is an independent contractor, agent, servant, or\nemployee of a person who holds the kind of license that authorizes the act, or is a\nthird party utilized by a direct shipper licensee as set forth in KRS 243.027.\n(2) The holding of any permit from the United States government to traffic in alcoholic\nbeverages without the corresponding requisite state and local licenses shall in all\ncases raise a rebuttable presumpt ion that the holder of the United States permit is\nunlawfully trafficking in alcoholic beverages.\n(3) Except as permitted by KRS 243.033, 243.036, 243.155, 243.157, and 243.260, a\nperson, conducting a place of business patronized by the public, who is not a\nlicensee authorized to sell alcoholic beverages, shall not permit any person to sell,\nbarter, loan, give away, or drink alcoholic beverages on the premises of the place of\nbusiness.\n(4) A licensee shall not permit any consumer to possess, give away, or d rink alcoholic\nbeverages or cannabis -infused beverages on the licensed premises that are not\npurchased from the licensee.\n(5) In a moist territory, the only types of licenses that may be issued are those that\ndirectly correspond with the types of sales app roved by the voters through moist\nelections within the territory, unless otherwise specifically authorized by statute.\n(6) Notwithstanding subsections (3) and (4) of this section, with the written permission\nof a licensed entertainment destination center:\n(a) A retail drink licensee located wholly within a licensed entertainment\ndestination center or that has a storefront sharing a physical boundary with\nthat licensed entertainment destination center may allow persons on the\nlicensee's premises to possess a nd drink alcoholic beverages that were\npurchased from another retail drink licensee located wholly within, or that has\na storefront sharing a physical boundary with, the licensed entertainment\ndestination center; and\n(b) A nonlicensed place of business tha t is located wholly within a licensed\nentertainment destination center or that has a storefront sharing a physical\nboundary with that licensed entertainment destination center may allow\npersons on its property to possess and drink alcoholic beverages that were\npurchased from a retail drink licensee located wholly within, or that has a\nstorefront sharing a physical boundary with, the licensed entertainment\ndestination center.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55925","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"0c54d58216acf43ca311ce250fb483ad82f47620797b9975972454a6ceb7e48b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.015","next":"us-ky/krs-243.025"},"notice":"GroundRules: Original legal text.
