{"data":{"id":"us-ky/krs-243.028","jurisdiction":"us-ky","citation":"KRS 243.028","heading":"Limitations on shipments of alcoholic beverages and cannabis -infused","body":"beverages by direct shipper licensees -- Notice and labeling requirements --\nRecipient age verification and signature required -- Penalty for consumer who\nattempts illegal receipt -- Shipping mode requirements.\n(1) A direct shipper licensee may sell or ship to a consumer all types of alcoholic\nbeverages or cannabis-infused beverages that the licensee is authorized to sell, with\nthe following aggregate limits:\n(a) Distilled spirits, in quantities not to exceed ten (10) liters per consumer per\nmonth;\n(b) Wine, in quantities not to exceed ten (10) cases per consumer per month;\n(c) Malt beverages, in quantities not to exceed ten (10) cases per consumer per\nmonth; and\n(d) Cannabis-infused beverages, in quantities not to exceed ten (10) cases per\ncustomer per month.\n(2) The direct shipper licensee shall notify the consumer placing the order that the\nshipment shall not be left unless the recipient of the shipment provides a valid\nidentification document at the time verifying that the recipient is at least twenty-one\n(21) years of age. All beverage containers shipped to the consumer shall be\nconspicuously labeled with the words \"CONTAINS ALCOHOL: SIGNATURE OF\nPERSON AGE 21 OR OLDER RE QUIRED FOR DELIVERY\" or \"CONTAINS\nCANNABIS-INFUSED BEVERAGES: SIGNATURE OF PERSON AGE 21 OR\nOLDER REQUIRED FOR DELIVERY\", as appropriate for each shipment.\n(3) At the time of delivery, the recipient of the shipment shall present to the individual\ndelivering the package a valid identification document. Prior to transferring\npossession of the package, the individual delivering the package shall visually\ninspect the document and verify the identity of the recipient and, by visual\nexamination or by using age ve rification technology, that the recipient is at least\ntwenty-one (21) years of age.\n(4) Before transferring possession of the package, the individual delivering the package\nshall obtain the signature of the recipient of the shipment. The individual who\nreceives and signs for the beverages is not required to be the consumer who\npurchased the beverages.\n(5) A consumer who intentionally causes shipment to an address deemed unlawful\nshall, for the first offense, be guilty of a violation punishable by a fine of two\nhundred fifty dollars ($250), and for each subsequent offense, be guilty of a\nviolation punishable by a fine of five hundred dollars ($500). In this instance, the\ndirect shipper licensee and the common carrier shall be held harmless.\n(6) A direct shipp er licensee may not sell or ship beverages to a consumer from its\nlicensed premises if the consumer's address is located in an area in which that type\nof beverages may not be sold or received.\n(7) Shipments made pursuant to this section shall be made through a common carrier.\n(8) If a common carrier is unable to complete delivery, then the beverages shall be\nreturned to the consignor.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55927","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"365e213e8504a008645553d59824f2c31978e59f114d2ac67456a52e7abd10aa","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.027","next":"us-ky/krs-243.029"},"notice":"GroundRules: Original legal text.
