{"data":{"id":"us-ky/krs-243.0307","jurisdiction":"us-ky","citation":"KRS 243.0307","heading":"Sampling license -- Sampling and sale of alcoholic beverages on premises","body":"of licensed retailer.\n(1) A sampling license may be issued to the holder of:\n(a) A quota retail drink license;\n(b) A quota retail package license;\n(c) A nonquota retail malt beverage package license;\n(d) An NQ1 license;\n(e) An NQ2 license;\n(f) An NQ4 retail malt beverage drink license; or\n(g) A distiller's license.\n(2) A sampling license shall authorize the licensee to allow customers to sample, free of\ncharge, distilled spirits, wine, and malt beverages under the following conditions:\n(a) Sampling shall be permitted only on licensed premises and by licensees\nholding a sampling license, during regular business hours;\n(b) A distillery shall provide samples as authorized by KRS 243.0305;\n(c) All other licensees shall limit a customer to:\n1. One (1) ounce of distilled spirits samples per day;\n2. Six (6) ounces of wine samples per day; or\n3. Twelve (12) ounces of malt beverage samples per day; and\n(d) A brewer, microbrewery, or out-of-state malt beverage supplier may conduct a\nsampling of malt beverages as permitted by this section at the licensed\npremises of a retailer licensee holding a sampling license.\n(3) Retailers holding a sampling license shall:\n(a) Notify the Department of Alcoholic Beverage Control at least seven (7) days\nin advance of conducting a free sampling event; and\n(b) Limit a sampling event to a period not to exceed four (4) consecutive hours\nbetween 12 noon and 8 p.m.\n(4) In addition to free sampling, a quota retail package licensee holding a sampling\nlicense may also sell sample distilled spirits and wine under the following\nconditions:\n(a) Paid samples may be sold only on licensed premises and by licensees holding\na sampling license, during regular business hours; and\n(b) A licensee shall limit a customer to purchased samples totaling no more than:\n1. Two (2) ounces of distilled spirits per day; and\n2. Nine (9) ounces of wine per day.\n(5) A quota retail package licensee holding both a  sampling license and a nonquota\nretail malt beverage package license may also sell samples of malt beverages under\nthe following conditions:\n(a) Paid samples may be sold only on licensed premises and by licensees holding\na sampling license, during regular business hours;\n(b) A licensee shall limit a customer to no more than sixteen (16) ounces of malt\nbeverages per day; and\n(c) The retail price of a sample shall not be less than a licensee's purchase cost of\nthe sample.\n(6) No customer shall be allowed to receive a combination of free and purchased\nsamples totaling more than:\n(a) Two (2) ounces of distilled spirits per day; and\n(b) Nine (9) ounces of wine per day.\n(7) Free and paid samples provided under this section shall not constitute drink sales.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50399","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"a9890c7dac8e51094d7ea1b095032dac74cf1a520f4b6a31d07aef2672ac8d34","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.0305","next":"us-ky/krs-243.031"},"notice":"GroundRules: Original legal text.
