{"data":{"id":"us-ky/krs-243.0341","jurisdiction":"us-ky","citation":"KRS 243.0341","heading":"Proposal of ordinance authorizing by the drink sales of alcoholic","body":"beverages in restaurants and dining facilities containing seating for at least\nfifty persons -- Qualifications -- Conditions -- Limited effect of ordinance.\n(1) Notwithstanding any other provision of law, the following local governments may\nelect to act under this section:\n(a) Any city or county that conducted an election under KRS 242.1244(2) prior to\nJanuary 1, 2016, for by the drink sales of alcoholic beverages in re staurants\nand dining facilities seating one hundred (100) persons or more; or\n(b) Any city with limited sale precincts created pursuant to KRS 242.1292 prior\nto July 14, 2022.\n(2) Upon a determination by the legislative body of a city or county that:\n(a) An economic hardship exists within the city or county; and\n(b) Expanded sales of alcoholic beverages by the drink could aid in economic\ngrowth;\nthe city or county may, after conducting a public hearing that is noticed to the\npublic in accordance with the K RS Chapter 424, adopt an ordinance authorizing by\nthe drink sales of alcoholic beverages in restaurants and dining facilities containing\nseating for at least fifty (50) persons and meeting the requirements of subsection (3)\nof this section.\n(3) The ordinance enacted by a city or county pursuant to subsection (2) of this section\nshall authorize the sale of alcoholic beverages under the following limitations:\n(a) Sales shall only be conducted in restaurants and other dining facilities meeting\nthe requirements of KRS 241.010(39)(a); and\n(b) The provisions of KRS 243.034 shall apply to any restaurant or dining facility\noperating under a license issued pursuant to this section.\n(4) A city or county acting under this section may allow limited restaurant sales as\ndefined in KRS 241.010(39).\n(5) The enactment of an ordinance under this section shall not:\n(a) Modify the city's or county's ability to issue a limited restaurant license to\nrestaurants or other dining facilities meeting the requirements of KRS\n241.010(39)(b); or\n(b) Affect, alter, or otherwise impair any license previously issued to a restaurant\nor dining facility meeting the requirements of KRS 241.010(39)(b).","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55949","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:52Z","sha256":"208d6e91d0d906c2384c957915f7a596e9cfb1abca3b0f0fc33142484f562713","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.034","next":"us-ky/krs-243.035"},"notice":"GroundRules: Original legal text.
