{"data":{"id":"us-ky/krs-243.081","jurisdiction":"us-ky","citation":"KRS 243.081","heading":"Retail sale of alcoholic beverages on a delivery, to-go, or take-out","body":"basis -- Prohibitions -- Requirements  -- Exemptions  regarding delivery\nvehicle signage -- Application of other laws.\n(1) If authorized under its licensing statute, a license holder with the privilege of\nselling alcoholic beverages by the drink at retail shall be permitted to sell\nalcoholic beverages by the drink in a sealed container, and by the package in\nsealed original containers, on a delivery, to-go, or take-out basis, as follows:\n(a) The  sale of alcoholic beverages pursuant to this section shall be in\nconjunction with the purchase of a prepared meal and only in quantities\nthat a reasonable person would purchase with a meal;\n(b) Deliveries, if applicable, shall be made  in a vehicle operated and owned\nby the licensee, the licensee's employee, or an independent contractor or\nagent; and\n(c) Any  person delivering alcoholic beverages shall be at least twenty-one\n(21) years of age.\n(2) All licensees and their employees and independent contractors are prohibited\nfrom:\n(a) Selling alcohol in bulk quantities;\n(b) Completing sales in dry territories; or\n(c) Delivering:\n1. Into dry territory;\n2. To a minor under twenty-one (21) years of age; or\n3. To an intoxicated person.\n(3) (a) For purposes of this section, alcoholic drinks to go shall be:\n1. Placed in a bag or other container that is secured in a manner that\nmakes  it visibly apparent if the container has been subsequently\nopened or tampered with; and\n2. Transported in a locked glove compartment or the trunk or other\narea that is not a passenger area under KRS 189.530(5).\n(b) The department may, but is not required to, promulgate an administrative\nregulation that sets forth the:\n1. Conditions under which sales may take place;\n2. Days and times that sales may take place; and\n3. The  requirements for transportation of alcoholic drinks to go under\nthis section.\n(4) For purposes of this section, vehicles used for deliveries shall be exempt from\ndisplaying the name  and license number  of the retail licensee selling the\nalcoholic beverages being delivered.\n(5) Except as provided in this section, sales of alcoholic beverages shall be\nsubject to all of the statutes and administrative regulations relating to the retail\nsale of alcoholic beverages.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50705","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"af0afe1e586eca6b26f2b11c6abecf3a273741d28a28ec07d5e0b33f20fc5fb7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.080","next":"us-ky/krs-243.0811"},"notice":"GroundRules: Original legal text.
