{"data":{"id":"us-ky/krs-243.082","jurisdiction":"us-ky","citation":"KRS 243.082","heading":"Nonquota  type 1 or NQ1  retail drink license -- Issuance to a","body":"convention  center or  convention  hotel complex,  horse  racetrack,\nautomobile  racetrack, railroad system, commercial  airline system  or\ncharter flight system, or state park -- Privileges, duties, and restrictions\nfor eligible entities.\n(1) A \"Nonquota type 1\" or \"NQ1\" retail drink license may be issued to an applicant\noperating as, or in:\n(a) A convention center or a convention hotel complex;\n(b) A horse racetrack;\n(c) An automobile racetrack;\n(d) A railroad system;\n(e) A commercial airlines system or charter flight system; or\n(f) A state park.\n(2) Any  licensee holding an NQ1  retail drink license located in a qualifying\nconvention center or a  convention hotel complex, horse racetrack, an\nautomobile racetrack, or state park may purchase, receive, possess, and sell\nalcoholic beverages at retail by the drink for consumption on the licensed\npremises. The license shall permit all alcoholic beverage sales on the premises\nwithout additional supplemental licenses. The licensee shall purchase alcoholic\nbeverages only from licensed wholesalers or distributors. The holder of an NQ1\nretail drink license under this section shall store alcoholic beverages in the\nmanner  prescribed in KRS 244.260.\n(3) A qualifying convention center or a convention hotel complex holding an NQ1\nretail drink license may also hold a supplemental hotel in-room service license.\n(4) A qualifying railroad system holding an NQ1  retail drink license may purchase,\nreceive, possess, and sell alcoholic beverages at retail by the drink or by the\npackage, upon any train that includes a dining car and is operated by the\nlicensee in the state. Sales shall be made  only while the train is in motion. A\nrailroad system  holding an  NQ1  retail drink license may  sell alcoholic\nbeverages in unbroken packages smaller than two hundred (200) milliliters of\ndistilled spirits and one hundred (100) milliliters of wine and may  purchase\nalcoholic beverages from nonresidents.\n(5) A  qualifying commercial airlines system or charter flight system holding an\nNQ1  retail drink license may  purchase, receive, possess, and sell alcoholic\nbeverages at retail by the drink, and by miniature bottle, for consumption upon\nregularly scheduled or charter flights of the licensee, in and out of Kentucky.\nThe license shall authorize the licensee to store alcoholic beverages for retail\nsale at a location or locations, if operating from more than one (1) airport in\nKentucky, as designated on the license application.\n(6) An NQ1  retail drink license may be issued to any qualifying applicant within a\nstate park meeting the criteria established in KRS  241.010 so long as the state\npark is located, in whole or in part, within:\n(a) Any wet territory; or\n(b) Any  precinct that has authorized the sale of alcoholic beverages under\nKRS  242.022.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45943","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"fa06d2231b73122d4f23bfe390aebfc49233397a1c7ea483e00835520cb78c0f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.0811","next":"us-ky/krs-243.083"},"notice":"GroundRules: Original legal text.
