{"data":{"id":"us-ky/krs-243.089","jurisdiction":"us-ky","citation":"KRS 243.089","heading":"Authorized public consumption license issued in wet territory to","body":"commercial quadricycle business.\n(1) An \"authorized public consumption\" license or \"APC\" license may be issued in wet\nterritory to an applicant operating as, or in a commercial quadricycle business.\n(2) The following qualifications are required before an APC license may be issued to a\ncommercial quadricycle business for the operation of quadricycles on a public\nhighway:\n(a) The applicant shall have a business office;\n(b) The applicant shall maintain general liability insurance of at least two million\ndollars ($2,000,000). No license shall be issued or renewed without written\ndocumentation of this insurance;\n(c) The applicant shall possess a permit issued by the local government that has\njurisdiction to grant rights to the applicant to operate its business on public\nroadways and highways within a specific designated operational area as its\npremises; and\n(d) If the local government that has jurisdiction for the premises as described in\nparagraph (c) of this subsection chooses to issue permits under this section,\nthat local government shall adopt an ordinance for operation of a commercial\nquadricycle business that contains:\n1. Hours of operation;\n2. Local licensing requirements;\n3. Any additional insurance requirements;\n4. Standards for the approval of authorized travel routes;\n5. Safety and equipment standards;\n6. Local inspection requirements;\n7. Standards for vehicle operation; and\n8. Standards for loading and unloading passengers.\n(3) A holder of an APC license that operates as a commercial quadricycle business:\n(a) May permit patrons to bring unopened packages of alcoholic beverages onto\nthe licensed premises and open and drink them in nondescriptive plastic cups\nafter boarding, and while riding, the quadricycle;\n(b) Shall not permit patrons to bring or possess any glass containers of alcoholic\nbeverages on the quadricycle;\n(c) Shall not permit patrons to bring opened packages or drinks of alcoholic\nbeverages from retail premises on the quadricycle;\n(d) Shall only permit patrons to drink and consume alcoholic beverages in\nnondescriptive plastic cups while riding the quadricycle; and\n(e) Shall not sell, permit, offer for sale, or provide or offer any samples of\nalcoholic beverages.\n(4) An employee driver of a commercial quadricycle business holding an APC license\nshall:\n(a) Be certified by the department's server training in alcohol regulations (STAR)\neducation program;\n(b) Not consume or be under the influence of alcoholic beverages or co ntrolled\nsubstances while driving and operating a quadricycle; and\n(c) Not be convicted of any criminal offense or violation related to alcoholic\nbeverages or controlled substances for a minimum period of two (2) years\nprior to employment.\n(5) Any local licensing fee imposed under KRS 243.060 or 243.070 for an APC license\nshall not exceed the amount imposed under KRS 243.030 for an APC license.\n(6) This section does not exempt the holder of an APC license from KRS Chapters 241\nto 244 or any administrative r egulation promulgated by the board, except as\nexpressly stated in this section.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45117","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"5d7eecd432b82cf03b0f9df87e949fe3c6cb17a27c2a89a42d3d36a2fc0b7fe5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.088","next":"us-ky/krs-243.090"},"notice":"GroundRules: Original legal text.
