{"data":{"id":"us-ky/krs-243.090","jurisdiction":"us-ky","citation":"KRS 243.090","heading":"Date licenses expire -- Reduction in fee for licenses less than six months --","body":"Renewals not to affect proceedings for violations -- Term of renewals -- Denial\nof renewal to delinquent taxpayer.\n(1) (a) All licenses issued by the department, ex cept special event licenses,\ntemporary licenses, or licenses listed in subsection (5) of this section, shall be\nvalid for a period of no more than a year.\n(b) The board shall promulgate administrative regulations establishing the year -\nround system for ren ewal of licenses. The system shall be designed to\ndistribute the workload as uniformly as possible within the offices of the local\nadministrators and the Department of Alcoholic Beverage Control.\n(c) For any application for a license issued by the departme nt through its\nauthority under this chapter or KRS Chapter 438, the license shall be\napproved or denied by the department no later than forty -five (45) days after\nthe department's receipt of the application.\n(2) (a) Except for licenses listed in paragraph (b) of this subsection, all licenses\nissued after January 1, 2017, by a local administrator shall be valid for a\nperiod of no more than a year and shall be renewable upon the date\nestablished by the department for the expiration of state licenses issued fo r\npremises located in that county or city. During the first year following July\n15, 2016, if the new date for renewal for the licensee does not occur on the\ndate established by the department for the expiration of the licensee's state\nlicense, the local administrator shall either:\n1. Prorate the cost of the renewed license by proportionally reducing the\ncost of the renewed license if the new date for the renewal occurs prior\nto the expiration of a previous license; or\n2. Provide a prorated provisional local  license to cover any period of time\nbetween the expiration of the previous license and the new date for\nrenewal if the new date for renewal occurs after the expiration of the\nlicensee's previous license.\n(b) Paragraph (a) of this subsection shall not appl y to licenses issued by a\nconsolidated local government, special event licenses, temporary licenses, or\nlicenses listed in subsection (5) of this section.\n(3) When any person applies for a new license authorized under KRS Chapters 241 to\n244, the person sh all be charged, if the license is issued, the full fee for the\nrespective license if six (6) months or more remain before the license is due to be\nrenewed and one -half (1/2) the fee if less than six (6) months remain before the\nlicense is due to be renewed. No abatement of license fees shall be permitted to any\nperson who held a license of the same kind for the same premises in the preceding\nlicense period and who was actually doing business under the license during the last\nmonth of the preceding license period.\n(4) The renewal by the department of any license shall not be construed to waive or\ncondone any violation that occurred prior to the renewal and shall not prevent\nsubsequent proceedings against the licensee.\n(5) All alcoholic beverage producers, wholesalers, o r distributors may obtain or renew\ntheir licenses for either a one (1) year term or a two (2) year term.\n(6) The department may deny license renewal if the licensee is a delinquent taxpayer as\ndefined in KRS 131.1815.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56755","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"3adfd56083cb7e00e3e9eab7fd05005afc0dc1d8221161b6f17f1ef3c7f8b35e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.089","next":"us-ky/krs-243.100"},"notice":"GroundRules: Original legal text.
