{"data":{"id":"us-ky/krs-243.100","jurisdiction":"us-ky","citation":"KRS 243.100","heading":"Persons who may not be licensed -- Evasion of license disqualification by","body":"certain persons -- Direct shipper exemption.\nAn individual shall not become a licensee if the individual:\n(1) (a) Has been convicted of any felony until five (5) year s have passed from the\ndate of conviction, release from custody or incarceration, parole, or\ntermination of probation, whichever is later;\n(b) Has been convicted of any misdemeanor involving a controlled substance that\nis described in or classified pursuan t to KRS Chapter 218A in the two (2)\nyears immediately preceding the application;\n(c) Has been convicted of any misdemeanor directly or indirectly attributable to\nthe use of alcoholic beverages or cannabis -infused beverages in the two (2)\nyears immediately preceding the application;\n(d) Is under the age of twenty-one (21) years; or\n(e) Has had any license relating to the regulation of the manufacture, sale, and\ntransportation of alcoholic beverages or the regulation of the sale, distribution,\nor transportation of cannabis-infused beverages revoked for cause or has been\nconvicted of a violation of any statute within KRS Chapters 241 to 244, until\nthe expiration of two (2) years from the date of the revocation or conviction.\n(2) A partnership, limited partners hip, limited liability company, corporation,\ngovernmental agency, or other business entity recognized by law shall not be\nlicensed if:\n(a) Each principal owner, partner, member, officer, and director does not qualify\nunder subsection (1)(a), (b), (c), (d), and (e) of this section;\n(b) It has had any license relating to the regulatio n of the manufacture, sale, and\ntransportation of alcoholic beverages or the regulation of the sale, distribution,\nor transportation of cannabis-infused beverages revoked for cause or has been\nconvicted of a violation of any statute within KRS Chapters 241  to 244, until\nthe expiration of two (2) years from the date of the revocation or conviction;\nor\n(c) Any principal owner, partner, member, officer, or director, or any business\nentity in which they were directly or indirectly interested, has had any licens e\nrevoked for cause or has been convicted of a violation of any statute within\nKRS Chapters 241 to 244, until the expiration of the later of two (2) years\nfrom the date of the revocation or two (2) years from the date of conviction.\n(3) The provisions of subsection (1)(a) and (b) shall apply to anyone applying for a new\nlicense under this chapter after July 15, 1998, but shall not apply to those who\nrenew a license that was originally issued prior to July 15, 1998, or an application\nfor a supplemental licen se where the original license was issued prior to July 15,\n1998.\n(4) A person shall not evade license disqualification by applying for a license through\nor under the name of a different person. The state administrators shall examine the\nownership, membership, and management of all license applicants, and shall deny\nthe application if a disqualified person has a direct or indirect interest in the\napplicant's business. The department may issue administrative subpoenas and\nsummonses to determine ownership of a n applicant or to investigate alleged\nviolations by a licensee.\n(5) A direct shipper license applicant shall be exempt from the requirements of this\nsection, and shall instead follow the requirements set forth in KRS 243.027.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55932","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"23a2a2dca7777c0be2e905af8797952b3152ece0a4c5de2a8a1e5ab4296dc208","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.090","next":"us-ky/krs-243.105"},"notice":"GroundRules: Original legal text.
