{"data":{"id":"us-ky/krs-243.120","jurisdiction":"us-ky","citation":"KRS 243.120","heading":"Business authorized by distiller's, rectifier's, or winery license -- Class A","body":"and Class B distiller's and rectifier's licenses -- Distiller's sale of distilled\nspirits by the drink.\n(1) A distiller's, rectifier's, or winery license shall auth orize the licensee to engage in\nthe business of distiller, rectifier, or winery at the premises specifically designated\nin the license, to maintain aging warehouses, and to transport for himself or herself\nonly any alcoholic beverage which he or she is aut horized under the license to\nmanufacture or sell. The licensee shall transport alcoholic beverages only by a\nvehicle operated by himself or herself, which has affixed to its sides at all times a\nsign of form and size prescribed by the state board, containi ng among other things\nthe name and license number of the licensee.\n(2) (a) 1. A licensee holding a distiller's license, Class A license, or Class B\nlicense shall distill no less than six hundred (600) gallons in one (1) year\nat the distillery's licensed premises.\n2. A licensee that engages in the distilling process for the exclusive\npurpose of providing training and education, conducting research, or\nteaching about the distilling process, aging, or bottling of distilled spirits\nshall be exempt from subparag raph 1. of this paragraph, so long as the\nlicensee does not produce spirits for sale to the general public.\n(b) Distillers that produce more than fifty thousand (50,000) gallons of distilled\nspirits per calendar year at the premises shall obtain a distille r's license, Class\nA.\n(c) Distillers that produce fifty thousand (50,000) gallons or less of distilled\nspirits per calendar year at the premises shall obtain a distiller's license, Class\nB (craft distillery).\n(3) (a) Rectifiers that rectify more than fifty  thousand (50,000) gallons of distilled\nspirits per calendar year at the premises shall obtain a rectifier's license, Class\nA.\n(b) Rectifiers that rectify fifty thousand (50,000) gallons or less of distilled spirits\nper calendar year at the premises shall obtain a rectifier's license, Class B\n(craft rectifier).\n(4) (a) A distiller that is located in wet territory, or in any precinct that has authorized\nthe limited sale of alcoholic beverages at distilleries under KRS 242.1243,\nmay sell distilled spirits by the drink or by the package at retail to consumers\nin accordance with KRS 243.0305.\n(b) Any distilled spirits sold under this subsection shall be taxed and distributed\nin the same manner as sales under KRS 243.0305(2).\n(c) Except as provided in this subsec tion, sales under this subsection shall be\ngoverned by all of the statutes and administrative regulations governing the\nretail sale of distilled spirits by the drink.\n(5) Nothing in this section shall be construed to:\n(a) Vitiate the policy of this Commonwealth supporting an orderly three (3) tier\nsystem for the production and sale of alcoholic beverages; or\n(b) Allow delivery or shipment of alcohol into dry or moist territory.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50974","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"72173621ce9bc05b44265ad986f87c7578916c0e34ef8b7f772358da0d8e3ced","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.117","next":"us-ky/krs-243.130"},"notice":"GroundRules: Original legal text.
