{"data":{"id":"us-ky/krs-243.130","jurisdiction":"us-ky","citation":"KRS 243.130","heading":"Transactions permitted to brewers, distillers, rectifiers, and wineries.","body":"(1) Sales and deliveries of distilled spirits and wine may be made  at wholesale,\nand from the licensed premises only:\n(a) By distillers to rectifiers, wineries, holders of special nonbeverage alcohol\nlicenses so far as they may make the purchases, or other distillers;\n(b) By rectifiers to wineries or to distillers if distilled spirits sold to distillers are\npackaged in retail containers;\n(c) By  wineries to rectifiers or other wineries, or to the holders of special\nnonbeverage alcohol licenses;\n(d) By distillers, rectifiers, or wineries to wholesalers; or\n(e) By distillers, rectifiers, or wineries for export out of the state.\n(2) No distiller, rectifier, or winery shall sell or contract to sell, give away, or deliver\nany alcoholic beverages to any person who is not authorized by the law of the\nstate of the person's residence, and of the United States government if located\nin the United States, to receive and possess those alcoholic beverages. Except\nas  provided in KRS  243.027 to 243.029 and KRS  243.0305, no distiller,\nrectifier, or winery shall sell or contract to sell, give away, or deliver any of its\nproducts to any retailer or consumer in Kentucky.\n(3) Employees  of distillers, rectifiers, and wineries may  sample the products\nproduced by that manufacturer for purposes of education, quality control, and\nproduct development.\n(4) Distillers may purchase distilled spirits only from other licensed distillers in this\nstate or in another state or province, but distillers may purchase from rectifiers\nlicensed in Kentucky, distilled spirits which are packaged in retail containers.\n(5) Rectifiers may  purchase malt, distilled spirits, and wine only from licensed\nbrewers, distillers, or wineries in Kentucky, or from nonresident brewers,\ndistillers, or wineries authorized by the law of the state of their residence and\nby  the United States government, if the brewers, distillers, or wineries are\nlocated in or outside the United States, to make the sales.\n(6) Wineries may purchase distilled spirits or wine only from licensed distillers or\nwineries in Kentucky, or from nonresident distillers or wineries authorized by\nlaw of the state of their residence, and by the United States government if\nlocated in the United States, to make the sales.\n(7) Nothing shall prohibit the purchase or sale of warehouse receipts by any\nperson, but this subsection does not authorize the owner of a warehouse\nreceipt to accept delivery of any distilled spirits unless the owner is a person\nwho  is permitted by law to receive the distilled spirits.\n(8) Nothing in this section shall be construed to:\n(a) Vitiate the policy of this Commonwealth  supporting an orderly three (3)\ntier system for the production and sale of alcoholic beverages; or\n(b) Allow delivery or shipment of alcohol into dry or moist territory.","path":["KRS Chapter 243"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50685","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:53Z","sha256":"f0d22448c78b7ab474c6f64d6703e6a7e52d2465d65670506ad521134e8cb79d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-243.120","next":"us-ky/krs-243.140"},"notice":"GroundRules: Original legal text.
